>> YES.

[1. Procedural]

THANK YOU AND WELCOME EVERYONE INTO THE WEDNESDAY, SEPTEMBER 1, 2021 REGULAR BOARD MEETING OF CERRITOS COLLEGE DISTRICT.

WE WILL BEGIN WITH A ROLL CALL.

PLEDGE OF ALLEGIANCE? I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA AND TO THE REPUBLIC FOR WHICH IT STANDS ONE NATION UNDER GOD INDIVISIBLE WITH LIBERTY AND JUSTICE FOR ALL.

>> IS THERE ANYONE WHO WISHES TO REORGANIZE THE AGENDA IN ANY WAY?

I MOVED TO ITEM.[INAUDIBLE] >> HELLO MY NAME.[INDISCERNABLE] THIS IS

[1.04 Comments from the Audience]

SEVERELY IMPACTED BY THE POLICIES AND IT IS RAISING CONCERN AND ALARM FOR CAMPUS POLICE AND OTHERS WITHIN THE LOS ANGELES COUNTY COMMUNITY.

WE WANT TO MAKE SURE THE EXISTING LAW THAT HAS ENACTED BY THE LEGISLATURE AND THE PEOPLE ARE PROPERLY BEING ENFORCED AND PROSECUTED BY THE DISTRICT ATTORNEY AND UNDER HIS CURRENT POLICY THAT HAS NOT BEEN THE CASE.

THERE WAS ALSO SOME DISCUSSION WHETHER OR NOT THE BOARD OF TRUSTEES OR THE APPROPRIATE ENTITY OR BODY IS PUSHING FORWARD WITH TAKING THE NO-CONFIDENCE VOTE.

I WOULD LIKE TO FOCUS AND STRESS ON THE FACT THAT STUDENTS ON CAMPUS ARE TAUGHT ABOUT THE LIMITATIONS OF GOVERNMENT AND TAUGHT ABOUT THE ROLES OF THE EXECUTIVE AND THE JUDICIAL BRANCHES.

AND, TO PREVENT AND ENSURE A RESPONSIBLE CITIZENRY AND RESPONSIBLE INVOLVEMENT BY THE CITIZENS IN THE PROCESS TO ENSURE THAT ELECTED OFFICIALS ARE HELD ACCOUNTABLE FOR THEIR ACTIONS AND THAT THEY ARE NOT ALLOWED TO ABUSE THEIR POWER BEYOND THE SCOPE OF THEIR AUTHORITY AND NOW WE HAVE A DISTRICT ATTORNEY WHO IS DOING PRECISELY JUST THAT.

IT'S DEFINITELY THE HOPE OF THE BOARD OF TRUSTEES THAT THEY WOULD PUT INTO PRACTICE THAT WHICH STUDENTS ON CAMPUS ARE BEING TAUGHT IN POLITICAL SCIENCE CLASSES AND IN PHYSICS, STUDENT GOVERNMENT CLASSES TO ENSURE THAT THERE IS A PROPER AND CONSISTENT APPROACH TO GOVERNMENT AND THAT IS ONE OF SEPARATION OF POWER AND ONE WITH CHECKS AND BALANCES AND THOSE WHO HAVE AMPLIFIED VOICES ARE ABLE TO USE THOSE VOICES TO BETTER SPEAK OUT AND BETTER ADDRESS THE CONCERNS WHEN THERE IS AN ABUSE OF POWER.

>> PRESIDENT: THANK YOU.

NOW, WE WILL MOVE ON TO ITEM 1.05 REPORTS AND COMMENTS FROM CONSTITUENT GROUPS.

[1.05 Reports and Comments from Constituent Groups]

DO WE HAVE DENNIS FALCONE?

[00:05:03]

>> PRESIDENTS JAMES CODY BIRKEY AND TRUSTEES AND BOARD MEMBERS.

MY HONORED COLLEAGUES AND REPRESENTATIVE OF THE STUDENT TRUSTEE AND OUR HONORED GUESTS AND COMMITTEE MEMBERS WELCOME TO TONIGHT THE FACULTY SENATE HAS BEGUN ITS WORK FOR THE FALL 2021 SEMESTER AND OUR COMMITTEES AND OUR VARIOUS OBLIGATIONS TO THE COLLEGE AND SHARED GOVERNANCE IS IN FULL SWING AND I AM PROUD OF THE WORK THAT THE FACULTY HAD BEEN DOING THROUGHOUT THE YEAR AND THROUGHOUT THE SUMMER AND WE WILL GO HEADLONG TO THE FOLSOM MASTER AND I CAN TELL YOU THE STATE OF THE FACULTY IS STRONG AND THEY ARE CONTINUING TO DO THE WORK THAT IS EXPECTED OF THEM WITH PROFESSIONALISM AND LEADERSHIP AND OBVIOUSLY THE SKILL THAT THEY HAVE.

I AM VERY PROUD TO REPRESENT THEM IN FRONT OF THE BOARD OF TRUSTEES.

HE RECENTLY CONTINUED OUR WORK WITH VARIOUS DISTRICT ADMINISTRATORS WITH THE ACCREDITATION REPORT.

AND WE RECENTLY HAD A GREAT REPORT BY VICE PRESIDENT LOPEZ THE BUDGET THAT WILL BE COMING BEFORE YOU RELATIVELY SOON.

IN THAT REGARD I AM HAPPY THAT WE ARE ABLE TO WORK SO WELL WITH THE VARIOUS CONSTITUENT GROUPS ON CAMPUS AND I HOPE TO CONTINUE WITH THAT WORK SO, INCORPORATED YOU VERY MUCH AND THAT'S ALL FROM ME TONIGHT.

>> PRESIDENT: THANK YOU.

VP DR. SHIN LIU?

>> SPEAKERS: THANK YOU.

TONIGHT TRAN 21 WOULD LIKE TO REAFFIRM OUR SUPPORT FOR VACCINATION AND TESTING RESOLUTION.

THE POLICY THE BOARD ADOPTED MAKES ANOTHER GREAT STRIDE TOWARDS PROVIDING NECESSARY LAYERS OF PROTECTION FOR OUR SCHOOL COMMUNITIES AND MAKE OUR SCHOOLS SAFER AS THE SCHOOL YEAR PROGRESSES.

CCFF CONTINUES TO ENCOURAGE OUR MEMBERS TO BE VACCINATED IF THEY ARE ABLE.

SINCE VACCINATION IS A LEADING HEALTH STRATEGY TO END THE COVID-19 PANDEMIC.

THE DELTA AND LAMBDA VARIANCE SEARCHING AND SB 95 WHICH IS THE CALIFORNIA CODE LEAF EXPIRING ON THE 30TH.

TRUSTEES WE HOPE YOU CAN HELP US INFLUENCE CALIFORNIA LAWMAKERS TO EXTEND THIS LEAVE.

WITHOUT AN EXTENSION MANY CALIFORNIA WORKERS WILL BE IN DANGER OF LOSING THEIR JOBS IF THEY ARE UNFORTUNATE ENOUGH TO GET INFECTED WITH COVID.

FACULTY WITHOUT SUFFICIENT SICK LEAVE WILL ALSO BE AT RISK OF LOSING PAY SHOULD THEY BECOME INFECTED WITH COVID.

ALLOWING THE EMERGENCY COVID LEAVE TO EXPIRE DIRECT THE FORCE BOTH VACCINATED AND UNVACCINATED INDIVIDUALS TO WORK WHILE THEY ARE SICK.

JEOPARDIZING THEIR HEALTH AND THE HEALTH OF COWORKERS AND THE PUBLIC.

TRUSTEES, WITH SB 95 EXPIRING PLEASE FURTHER CONSIDER EXTENDING OUR DISTRICTS SUPPLEMENTAL COVID SICK LEAVE BEYOND SEPTEMBER 30.

THE SAFETY OF OUR FAMILIES AND COMMUNITIES ARE IN YOUR HANDS.

THANK YOU.

>> PRESIDENT: THANK YOU DOCTOR LONG.

MS. LOPEZ?

>> SPEAKERS: GOOD EVENING TRUSTEES AND GUESTS.

I WILL ALSO ECHO WHAT MY FELLOW TRAN 21 PRESIDENT IS ASKING OF YOU TONIGHT TO EXTEND THE SB 95 LEAD AND EXTENDED UNTIL THE END OF THE RESOLUTION WAS PASSED TO THE BOARD.

YOU WILL BE ABLE TO SUPPORT NOT ONLY CLASSIFY FACULTY THROUGHOUT THE CALENDAR YEAR OF 2022.

WE ARE ASKING YOU FOR THE SUPPORT AND WE ARE HOPING THAT YOU WILL BE ABLE TO PROVIDE OUR MEMBERS WITH A LITTLE BIT OF COMPASSION AS WE GET THROUGH THIS PANDEMIC.

I ALSO ECHO THE SENTIMENT OF MR. FALCONE OUR PRESIDENT.

WE ARE WORKING IN COLLABORATION AND WE CONTINUED/TO LOOK FORWARD AND SHARE OUR THOUGHTS THAT ARE NOT JUST OURS BUT OF OUR MEMBERSHIP AS WELL.

THANK YOU FOR TONIGHT AND ALLOWING US TO SHARE OUR CONCERNS AND I HOPE YOU TAKE THOSE INTO CONSIDERATION WHEN YOU ARE MAKING FUTURE DECISIONS.

THANK YOU.

>> PRESIDENT: THANK YOU MS. LOPEZ.

WE WILL MOVE TO OUR OPEN SESSION AGENDA CONSISTING OF THE COVID-19 CAMPUS SAFETY.

[2.01 Institutional Presentation: COVID-19 Campus Safety Protocols Update]

[00:10:01]

>> SPEAKERS: THANK YOU MR. PRESIDENT.

GOOD EVENING EVERYONE.

IT IS GOOD TO BE BACK AND WE HAVE HAD A VERY GOOD FEW WEEKS BACK ON CAMPUS.

IT HAS BEEN A LOT OF WORK THAT EVERYONE HAS PUT IN TO GET TO THIS POINT.

I WILL DETAIL THAT A LITTLE LATER ON THIS EVENING.

FOR NOW, WERE GOING TO TELL YOU ABOUT COVID-19 CAMPUS SAFETY PROTOCOLS AND THE LAST MEETING DOCTOR SALAZAR ASKED TO PRESENT INFORMATION ABOUT WHAT OTHER COLLEGES AROUND THE REGION HAVE BEEN DOING REGARDING VACCINATION TESTING AND FURTHER MANDATES TO KEEP STUDENTS, FACULTY AND THE COMMUNITY AT LARGE SAFE.

SO, LET ME START WITH A BRIEF SUMMARY OF WHAT WE ARE CURRENTLY DOING ON CAMPUS.

AS YOU PROBABLY REMEMBER WE HAD THE BACK TO CAMPUS PLAN WHICH WE HAD BEEN FOLLOWING CLOSELY.

WE HAVE BEEN VERY SUCCESSFUL WITH EVERYONE AGREEING TO FOLLOWING THE PROTOCOLS.

SOME OF THE PROTOCOLS ARE WHEN YOU CHECK IN.

STUDENTS FACULTY AND ADMINISTRATORS AND ESSENTIALLY EVERY SINGLE GROUP ON CAMPUS HAVE IN VERY GOOD FOLLOWING THOSE PROTOCOLS.

WHEN WE WALK AROUND CAMPUS, EVERY TIME I'M IN THE BUILDING OR I SEE THE STUDENTS OR EVERYONE IN GENERAL ARE WEARING MASKS AND STAYING SOCIALLY DISTANT.

AND WEARING THEIR WRISTBAND AND ESSENTIALLY DOING EVERYTHING THEY ARE REQUIRED TO DO.

EVEN WHEN WE WALK OUTSIDE WE CONTINUE TO SEE INDIVIDUALS FOLLOWING PROTOCOLS WHICH HAVE LED OBVIOUSLY TO A VERY LOW NUMBER OF POSITIVE CASES.

HOWEVER, THOSE CASES HAVE NOT ORIGINATED ON-CAMPUS MEANING THEY HAD ALREADY ACQUIRED THE INFECTION ELSEWHERE WHEN THEY WERE TESTED FOR ANY CAMPUS PROTOCOL.

IT SEEMS THAT THE PROTOCOL ARE WORKING.

BEFORE WE PASS THIS RESOLUTION, WE ASKED THE ADMINISTRATION TO CREATE A VACCINATION PROGRAM AND WE HAVE WORKED VIGILANTLY ON THAT SECURING MEDICAL RECORD PRIVACY TESTING PARTNERS AND HIRING TO HELP US IMPLEMENT THAT.

WE ARE ON TARGET FOR OCTOBER 1 FOR A RESOLUTION OF OCTOBER 30.

WE SHOULD HAVE EVERYTHING READY FOR IMPLEMENTATION.

THIS INCLUDES THE SOFTWARE FOR THE CHECK IN PROCEDURES, THE CONVERSATIONS AND NEGOTIATIONS WITH OUR LABOR GROUPS AND THEY ARE TAKING PLACE AT THIS PARTICULAR TIME.

AND OBVIOUSLY, TESTING ON CAMPUS, WE HAVE BEEN ABLE TO ACCOMPLISH ALL OF THAT AND WE ARE PUTTING ALL THE PIECES TOGETHER TO BEGIN THE PUZZLE.

THE PROGRAM ALSO HAS A CAMPAIGN AND THIS CAMPAIGN IS TO CREATE AWARENESS OF WHAT IS EXPECTED OF THEM AND ESSENTIALLY MAKING SURE THAT EVERYONE IS INFORMED OF WHAT WE NEED TO DO ONCE THIS POLICY BECOMES ACTIVE.

NOW, WE GO TO WHAT OTHER DISTRICTS AROUND THE STATES ARE DOING.

WE HAVE HERE ALL OF THE DISTRICTS THAT HAVE TAKEN ACTION.

REMEMBER, THEY ARE DISTRICTS THAT HAVE 75 DISTRICTS.

SO, ESSENTIALLY WE TAKE TWO OF THEM THAT ARE REQUIRING VACCINATION.

FIVE HAVE APPROVAL VACCINATION OF REGULAR TESTING AND FIVE ARE OPEN TO HAVE VACCINATION REQUIREMENTS PENDING BOARD ACTION.

[00:15:05]

9 OF THEM AND THAT NUMBER IS NOT NECESSARILY ACCURATE.

BUT, 29 OF THEM HAVE TAKEN MANDATES ON MASKS.

THE REST OF THAT IS A COMBINATION OF MASKS, VACCINATION AND TESTING, SIMILAR TO WHAT WE HAD HAD.

WE WERE TAKING A FULL MONTH ACTION FROM THE BOARD FOR THE MASS MANDATE FOR CAMPUS SAFETY PROCEDURES AND WE HAVE BEEN DOING THIS FROM THE VERY BEGINNING WITH

[00:42:29]

SUPPORT ACROSS THE ENTIRE COMMUNITY.

[5.01 Second Reading and Consideration of Adoption: Proposed New Board Policy 2905 - SARS CoV-2 (COVID-19) Vaccination and Testing Requirement]

[5.02 Requested by Trustee Lewis: Consideration of Adoption of Resolution #0818A Expressing a Vote of No Confidence in Los Angeles County District Attorney George Gascon]

[6. Reports and Comments from District Officials]

[7. Closed Session]

[02:08:08]

ONE OF OUR LOCAL PARTNERS, THESE ARE COLLEGES THAT HAVE BEEN RELATIVELY CLOSED FROM

[02:08:10]

CERRITOS COLLEGE.

[02:08:11]

CERRITOS COLLEGE EXTENDED IMPLEMENTATION FOR VACCINATION AND TESTING AND

[02:08:13]

AT THIS PARTICULAR POINT YOU CAN SEE IT IS ONLY INDOOR MASKING.

[02:08:15]

AND, WE ARE TRYING TO MOVE TO THE VACCINATION AND YOU CAN SEE MOST OF THE

[02:08:17]

DISTRICTS REQUIRE MANDATED VACCINATION WITH EXCEPTION OF LONG BEACH CITY COLLEGE

[02:08:19]

AND CERRITOS COLLEGE WHO HAVE VACCINATION AND TESTING.

[02:08:21]

OBVIOUSLY EVERYONE AROUND HERE IS IMPLEMENTING A FORM OF VACCINATION TESTING AND

[02:08:23]

MASK MANDATES.

[02:08:24]

ONLY A COUPLE OF DISTRICTS AS YOU SEE THERE, ARE IMPLEMENTING ONLY MASK

[02:08:26]

MANDATES BUT AT THE LAST MAJORITY, ONLY TWO OF US HAVE MASK MANDATES,

[02:08:29]

VACCINATION AND TESTING.

[02:08:30]

THAT WILL BE LONG BEACH AND CERRITOS COLLEGE.

[02:08:32]

AS WE LOOK INTO THE FUTURE, OBVIOUSLY, IT IS IMPORTANT TO REMEMBER RESOLUTION AND

[02:08:34]

BOARD POLICY WITH AN EXPIRATION DATE OF JUNE 30 THAT IS FOR THE TESTING.

[02:08:36]

AND, REALISTICALLY SPEAKING IT IS IMPORTANT TO REMEMBER THAT WE ARE GOING TO LEAD IN

[02:08:38]

A SITUATION THAT WE ARE IN RIGHT NOW OR SIMILAR TO THE POSSIBLE FUTURE.

[02:08:40]

I DO NOT THINK THAT COME SPRING SEMESTER WE ARE GOING TO SEE THAT COVID IS WITH

[02:08:41]

US.

[02:08:42]

I DO NOT THINK WE WILL SEE THAT.

[02:08:44]

THE VACCINATION RATES COULD INCREASE BY PERCENTAGE AND WE WILL NOT SEE AN INCREASE IN COVID IN THE UPCOMING MONTH.

DO NOT THINK THAT WILL HAPPEN.

WHAT I SEE HAPPENING IS OBVIOUSLY LIFE WITH COVID.

AS WE SEE IT FOR THE FORESEEABLE FUTURE AND THERE ARE SOME RESTRICTIONS AND ACCOMMODATIONS AND TECHNIQUE OF BEING ABLE TO CONDUCT REGULAR BUSINESS AND CONTINUE TO BE DEVELOPED AS WE ARE TESTING IN THIS SEMESTER AND POTENTIALLY IN THE SPRING SEMESTER.

AT LARGE, WE CAN SEE A LOT OF OUR COUNTY AGENCIES ARE MOVING INTO A VARIATION OF EITHER VACCINE AND TESTING AND THEN SOME ARE MOVING INTO VACCINES ONLY.

AS WE ALL ARE AWARE, CONCERNS ARE OF THE IMPLEMENTATION OF THESE PARTICULAR POLICIES AND THAT IS BECOMING THE NORM IN OUR COUNTY AND IN NEIGHBORING COUNTIES AND I DO BELIEVE IT IS MOSTLY TO GIVE US THE ABILITY TO CONDUCT BUSINESS IN A MANNER THAT IS RELATIVELY SAFE WITHOUT CONTINUING TO SAY THAT THE VACCINE IS GOING TO COMPLETELY ELIMINATE THE TREND OF COVID-19.

AGAIN, THIS IS WHAT OUR ONCOLOGIST IS RECOMMENDING.

AND WE CAN ANSWER ANY QUESTIONS REGARDING PROCESSES THAT THEY ARE DOING, WITH THE EFFECTIVENESS OF WHAT THEY ARE DOING, WHAT WE ARE DOING AT THIS PARTICULAR TIME.

THANK YOU.

SP1 THANK YOU DOCTOR.

DO WE HAVE ANY DISCUSSION ON THIS ITEM? YES, TRUSTEE PEREZ?

>> TRUSTEE: HAD SOME QUESTIONS.

IN REGARDS TO THE STUDENT WITH THE VACCINATION WHAT IS REQUIRED ACCORDING TO THE GUIDELINE? IS THAT VOLUNTARY?

>> SPEAKERS: AT THIS PARTICULAR TIME, YES.

ONCE WE IMPLEMENT THE WORK POLICY ESSENTIALLY EFFECTIVE OCTOBER 1, ALL OF US WILL BE REQUIRED TO SUBMIT OUR APPROVAL OF VACCINATION OR APPROVAL OF TESTING.

THERE ARE A COUPLE OF DIFFERENT WAYS THAT WE CAN DO THAT.

BOTH THE STAFF WILL USE DIFFERENT INSTANCES OF OPTIMUM HQ.

THE SYSTEMS ARE NOT CONNECTED WE ARE JUST SIMPLY USING THE SAME BACKGROUND SYSTEM TO MAINTAIN THE PRIVACY OF RECORDS.

SO, THE REGULAR ISSUES WITH THE VACCINATION, THAT IS ONE OF THE DOCUMENTS THAT IS ACCEPTED IN THE NEXT ONE IS THE VACCINATION RECORD THAT IS ISSUED BY LA COUNTY.

AND, THE CALIFORNIA REGISTRY.

THOSE ARE THE PIECES THAT ARE REQUIRED.

TESTING, WE REQUIRE AN OFFICIAL RESULT FROM AN OFFICIAL PROVIDER.

I DO KNOW THERE ARE DIFFERENT FORMS OF RAPID TESTING THAT YOU CAN ACQUIRE AT THE STORE BUT WE ARE NOT ACCEPTING THOSE.

WE ARE ONLY EXCEPT THING AND OFFICIAL RECORD AT THIS TIME.

THE RECORDS ARE KEPT CONFIDENTIAL AND NO ONE OUTSIDE OF HR OR PERSONNEL AT THE STUDENT HEALTH SERVICES WILL HAVE ACCESS TO THOSE OR BE ABLE TO REVIEW

[02:10:01]

THAT.

NO FACULTY, STAFF OR ADMINISTRATOR WILL HAVE THE ABILITY TO ASK FOR APPROVAL OF VACCINATION OR TESTING.

THE SYSTEM, IT IS UPDATED WILL GIVE THE STUDENTS AND ALL OF US, THE STAFF, CLEAR BASED ON THE DOCUMENTS THEY HAVE.

>> TRUSTEE: THANK YOU VERY MUCH.

IN REGARDS TO TRAINING, ALL THE DIFFERENT PROCEDURES THAT ARE GOING TO BE IMPLEMENTED ON OCTOBER 1, TELL ME ABOUT THAT AND HOW WE CAN ENSURE THAT WE ARE ALL PROPERLY TRAINED.

>> SPEAKERS: THE FIRST THING WE HAVE DONE IS TO COME INTO A CAMPUS PLAN.

THE DOCUMENT HAS BEEN WIDELY DISTRIBUTED AND WE HAVE HELD A NUMBER OF FORUMS TO ANSWER QUESTIONS AND SO ON AND SO FORTH WITH THIS PROCESS THAT WE HAVE CREATED WE HAVE VIDEOS FOR THE CHECK-IN PROCESS AND MANY OF OUR FACULTY STAFF ADMINISTRATORS, STUDENT, EVERYONE HAS BEEN INVOLVED FOR THE MOST PART IN THIS PROCESS.

THE NEW PIECES THAT WE WILL BE USING IN THE COMPONENTS WILL BE DELIVERED TO EDUCATION AND A PR CAMPAIGN PRIOR TO THE IMPLEMENTATION DURING THE FIRST MONTH TO BE COME COMPLIANT.

>> TRUSTEE: OKAY.

WE TALKED A LITTLE BIT ABOUT THIS LAST MONTH AND TO MAKE SURE I UNDERSTAND IT, STUDENTS ARE NOT GOING TO BE REQUIRED TO EITHER PAY FOR A VACCINE, THEY CAN GET IT ON CAMPUS FOR FREE, IS THAT CORRECT?

>> SPEAKERS: SO, WE ARE ADMINISTERING THE MODERNA ONLY.

THE REASON WE ONLY HAVE MODERNA IS BECAUSE WE DON'T HAVE ALL THE MECHANISMS TO DO THE PFIZER.

THEY HAVE TO MAKE AN APPOINTMENT BECAUSE EACH VACCINE BILE COMES WITH 10 DOSES AND THEY ARE ONLY GOOD FOR SIX OR EIGHT HOURS.

WE WILL HAVE TO RECORD WHAT WE ACTUALLY ADMINISTER AND WASTE.

BASED ON THAT WE WILL GET ANOTHER GROUP OF VACCINATIONS.

BEYOND THAT WE WILL NOT BE GIVING OTHER VACCINATIONS.

THEY HAVE TO MAKE AN APPOINTMENT AND ONCE WE GET BEYOND THAT WE WILL HAVE EVERYONE COME IN AT NO CHARGE.

>> TRUSTEE: IF THEY CHOSE TO NOT GET VACCINATED INSTEAD OF THE TESTING ROUTE, DO THEY HAVE TO MAKE AN APPOINTMENT AND GO TO THE HEALTH CENTER FOR THAT AND IS THAT FREE?

>> SPEAKERS: AT THE MOMENT THEY HAVE TO MAKE AN APPOINTMENT AT THE HEALTH CENTER AND THE TESTING IS CONDUCTED ACCURATELY SINCE MARCH.

ONCE WE GET THE ADDITIONAL TESTING THEY WILL HAVE THE OPTION TO EITHER GO TO THE STUDENT HEALTH CENTER OR GO TO AN ADDITIONAL PROVIDER WE HAVE ON CAMPUS AS LONG AS THEY ARE USING OUR SERVICES.

>> TRUSTEE: HAVE THERE BEEN ANY CONCERNS EXPRESSED BY STUDENTS WHO HAVE TESTED POSITIVE AND ARE HAVING A HARD TIME CATCHING UP OR COMPLETING THEIR WORK BECAUSE THEY WERE TOO SICK TO REALLY BE DOING ANY WORK DURING THAT PERIOD?

>> SPEAKERS: I HAVE NOT HEARD ANYTHING.

FACULTY HAS BEEN ACCOMMODATING.

WHEN STUDENTS GO MISSING FOR A LONG PERIOD OF TIME, THE RECOMMENDATION IS TO ASK FOR A MEDICAL WITHDRAWAL.

FOR THE MOST PART WE HAVE BEEN MOVING A LOT OF ASSIGNMENTS TO WORK TO THE ONLINE ENVIRONMENT.

THAT CAN WORK IN BOTH WAYS.

THE STUDENTS WILL ONLY BE MISSING THE LIVE LESSON.

AND BECAUSE THIS THING WE HAVE HERE IN THE MIDDLE, OUR CAMERA, THOSE CLASSROOMS NOW WORK WITH THAT.

AND THE STUDENT WHO IS HOME, OR THEY CANNOT BE THERE FOR ANY OTHER REASON, THEY SHOULD BE ABLE TO WATCH THE LECTURE ONLINE.

THAT HAS BEEN SOMETHING THAT THE FACULTY HAS BEEN DOING DILIGENTLY.

THE ONLY OTHER THING WE HAVE WITH THAT IS THE STUDENTS ON THE CLINICAL SIDE TO MAKE SURE THEY ACCOMPLISH A SPECIFIC NUMBER OF HOURS IN AN ACTUAL CLINICAL SETTING.

>> TRUSTEE: THAT IS GOOD.

I KNOW THAT A LOT OF STUDENTS ARE STRUGGLING WITH THAT.

SO, IT'S AN ACCOMMODATING SITUATION AND THAT'S GOOD TO HEAR.

I THINK THOSE ARE ALL THE QUESTIONS I HAVE.

NO, ONE MORE.

THESE ARE IMPLEMENTED OCTOBER 1? WHEN WOULD YOU BE ABLE TO PRESENT TO THE BOARD THE DATA OF THE NUMBER OF EMPLOYEES WHO ARE VACCINATED IN THE NUMBER OF STUDENTS VERSUS THOSE WHO AREN'T WHO ARE CHOOSING TO DO THE RETESTING.

>> SPEAKERS: THE FIRST FEW DAYS EVERYONE WILL HAVE THAT WINDOW TO SUBMIT THE PAPERWORK AND WE WILL SAVE THE DATA AND COLLECT IT AND USE THAT FOR DATA AND USE THAT AT THE PRESENTATION OF WHAT WE COULD EXPECT TO SEE IN THE MONTH TO COME.

I WILL SAY IF WE ARE ABLE TO BUILD AN INCENTIVE PLAN TO GET PEOPLE VACCINATED AND I WOULD SAY 60 TO 90 DAYS TO GET AN ACTUAL COUNT AND WE WILL GET UPDATES AS WE GO.

WE WILL GET ACCURATE COUNTS ON WHAT WE COULD EXPECT TO SEE GOING FORWARD FOR A TOTAL OF 90 DAYS BECAUSE I THINK WE FEEL THAT THAT WOULD BE A GOOD INCENTIVE PLAN FOR STUDENTS AND FACULTY AND STAFF AND ADMINISTRATORS TO BECOME VACCINATED AND WE WILL BE ABLE TO GET A FEW MORE.

>> TRUSTEE: THANK YOU.

>> PRESIDENT: YES.

TRUSTEE?

>> TRUSTEE: YES, I KNOW THAT DOWNEY HAS THE HUB FOR TESTING FOR COVID.

WOULD THAT BE ONE OF THE ACCEPTABLE SITES WHERE YOU COULD GET A RESULT?

>> PRESIDENT: YES.

>> SPEAKERS: ANYONE OF THESE FACILITIES PROVIDE YOU WITH A CERTIFICATE AND IT WILL BE APPROPRIATE.

WHAT WE ARE TRYING TO SAY IS STAY AWAY FROM SELF TESTING BECAUSE THAT IS MUCH HARDER FOR US TO VERIFY.

>> AND FOR VACCINATIONS THE COUNTY DOES HAVE A HUB AND NO APPOINTMENT IS NEEDED.

ANYONE CAN WALK IN AND GET VACCINATED.

I REALIZE THAT THERE THEY DO HAVE THE PFIZER AND THE JOHNSON AND JOHNSON.

AND AT NO COST.

IT IS FREE.

THAT, THERE ARE PLENTY OF PUBLIC HEALTH SITES THAT ARE FORMING A HUB SO THAT THEY CAN GET OUTREACH TO AS MANY STUDENTS AND I KNOW THAT DOES EXIST.

IF ANYONE, AND THEY ARE OPEN SIX DAYS A WEEK.

SO, THE AVAILABILITY IS THERE FOR THE STUDENTS OR FACULTY TO GET VACCINATED AND THERE IS NO WAIT TIME.

>> SPEAKERS: THERE IS ONE MORE THING I WOULD LIKE TO MENTION AND IT IS THAT WE HAVE A CAMPUS OF STUDENTS THAT WHERE THE WHITE CERRITOS COLLEGE T-SHIRTS AND THEY ARE STUDENTS THAT ARE THERE TO HELP STUDENTS, VISITORS, FACULTY, ANYONE THAT NEEDS HELP TRYING TO CHECK IN.

NEEDS HELP GOING TO ANYWHERE ON CAMPUS.

AND, TO TRY TO ENCOURAGE PEOPLE TO FOLLOW THE PROTOCOLS.

WE ARE ACTIVELY AVOIDING USING LAW ENFORCEMENT TO IMPLEMENT ANY OF THESE RULES.

WE ARE ACTUALLY AVOIDING USING COLLEGE ADMINISTRATORS, FACULTY, STAFF, TOO ENFORCE ANY OF THESE RULES.

OF COURSE, I AM A PROFESSOR AND I AM IN A CLASSROOM AND I SEE A STUDENT WITHOUT A WRISTBAND IT IS MY PREROGATIVE TO ASSESS THE STUDENT AND DO THE PROPER CHECK-IN.

BUT DO THEY ACTUALLY DO ENFORCEMENT OUTSIDE AND GUIDANCE AND SO ON AND ACTIVELY KEEP PEOPLE AWAY PARTICULARLY LAW ENFORCEMENT.

WE DO NOT WANT TO USE LAW ENFORCEMENT FOR ANY OF THIS BECAUSE AS FAR AS WE ARE CONCERNED THIS IS NOT A POLICE ISSUE.

IT IS NOT A LAW ENFORCEMENT ISSUE.

IT IS SOMETHING WE CAN DO WITH OUR CONVERSATION.

IT IS WORKING VERY WELL.

IS THERE ANYTHING ELSE THAT YOU WOULD LIKE TO MENTION SINCE, OBVIOUSLY, THE FIRST PART WAS THE REQUEST?

>> TRUSTEE: NO, THANK YOU DR. JOSE FIERRO.

I APPRECIATE THE INFORMATION AND YOU FORGOT TO MENTION THAT PFIZER IS NO FDA APPROVED.

I HAVE SOME CONCERNS.

IF YOU LOOK AT THE SLIDE THAT YOU MENTIONED, OUR SURROUNDING COLLEGES, THEY HAVE ALL MANDATED THE VACCINE AND PRETTY MUCH OVER HALF OF THEM HAVE MANDATED THE VACCINE.

I WOULD LIKE TO START A DISCUSSION TO SEE HOW THE BOARD MEMBERS FEEL REGARDING MANDATORY VACCINATION AND SEE IF WE CAN ADD THAT TO THE RESOLUTION, I AM SORRY, THE SECOND READING THAT IS COMING LATER ON IN THE BOARD MEETING AND I THINK, I AM REPEATING MYSELF, I FEEL LIKE I AM REPEATING MYSELF BUT SOUTHEAST LA WHICH CERRITOS COLLEGE SERVES HAS BEEN HARDEST HIT BY COVID WE HAVE THE HIGHEST CASES AND HIGHEST NUMBER OF DEATHS IN LA COUNTY AND THIS IS THE COMMUNITY THAT CERRITOS COLLEGE SERVES.

DOWNEY, SINCE THE BEGINNING OF COVID CONTINUES TO BE AN EPICENTER.

I HAVE HAD TO LIVE THROUGH THIS AND NOTHING HAS CHANGED FROM MARCH UNTIL NOW.

EVERY TIME THERE IS AN OUTBREAK OF CASES WE FEEL IT IN DOWNEY.

AS A PHYSICIAN AND BOARD MEMBER I FEEL IT IS APPROPRIATE AND RESPONSIBLE FOR US TO PRETTY MUCH FOLLOW THE NEED OF - WE CANNOT SAY WE ARE THE LEADER BUT TO FOLLOW THE LEAD OF OUR SURROUNDING COLLEGES AND REALLY TALK ABOUT MANDATING THE VACCINATION.

IT WOULD LEAD TO LESS OUTBREAKS AND LESS DISRUPTION AT THE COLLEGE.

I WOULD BE INTERESTED TO SEE HOW THE BOARD MEMBERS FEEL ABOUT ADDING SOMETHING IN THAT RESOLUTION TO MANDATE THE VACCINE.

>> PRESIDENT: INCORPORATED YOU TRUSTEE DR. SANDRA SALAZAR.

I THINK THAT LEADS TO A QUESTION PERHAPS ONE OF THE THINGS THAT WE DID WHEN WE SET UP THIS PROTOCOL WAS TO TRY TO CREATE A ROUND OF ACCOMMODATION FOR DIFFERENT FOLKS IN TERMS OF VACCINATIONS OR IF THERE WAS ANOTHER LIMITATION IN FRONT OF THEM OR IF THEY WERE NEEDED TO CHOOSE NOT TO GET A VACCINATION TO STILL BE TESTED OR STAY-AT-HOME AND ATTEND CLASS ONLINE.

FROM THAT STANDPOINT I THINK ONE OF THE THINGS WE WERE LOOKING AT IS THE RAMIFICATIONS OF NOT ONLY THE THEOLOGICAL STANDPOINT AND LEGAL STANDPOINT FOR CREATING THOSE ACCOMMODATIONS.

I THINK TRUSTEE DR. SANDRA SALAZAR BRINGS UP A VALID POINT.

THERE ARE A NUMBER OF DISTRICTS THAT IT APPEARS THEY ARE NOT OR THEY DO NOT HAVE THAT IS A MAJOR PART OF THEIR PROTOCOL.

>> SPEAKERS: THANK YOU.

THERE ARE A FEW THINGS TO CONSIDER.

IN ADDITION TO WHAT YOU SEE THERE, ALL CSU AND UC'S HAVE REQUIRED VACCINATION.

THERE IS NO TESTING OPTION.

EVEN IF WE CONTINUE WITH OUR CURRENT POLICY FOR TRANSFER STUDENTS WHO TRANSFER INTO ANY CSU OR UC OR USC BE REQUIRED TO VACCINATE IN ORDER TO ATTEND BASED ON THE TESTING OPTION.

SOME HESITATION THAT WE HAVE IN THE BEGINNING WHERE WE HAD THESE DISCUSSIONS WAS ONE OF WHAT JAMES CODY BIRKEY MENTIONED AND LACK OF FDA APPROVAL.

BUT, THAT CHANGED ONCE THE FDA APPROVED THE PFIZER VACCINE WHICH ACCORDING TO THE CONVERSATIONS THAT WE HAD WITH OUR LEGAL REPRESENTATIVE AND OUR REPRESENTATIVES FROM THE CHANCELLOR'S OFFICE, THERE WAS NOT NECESSARILY A NEGATIVE IMPACT ON ACQUIRING MANDATORY VACCINATION PRIOR TO GETTING FDA APPROVAL.

THE ISSUE WAS MORE ON THE STUDENT AND PEERED THAT THE STUDENTS COULD CHALLENGE THAT.

AND, WITH THE EMPLOYEES, THERE WAS NO PRESIDENT ABLE TO IMPLEMENT BASED ON SPRING

[02:15:01]

COURT DECISIONS.

THERE WAS A CHALLENGE AND WITH THE APPROVAL OF THE VACCINE ESSENTIALLY THAT COULD MAKE IT LIKE ANY OTHER VACCINE THAT IS REQUIRED IN A COMMUNICABLE DISEASE WHICH MEANS THEY ARE NOT LEGAL RAMIFICATIONS OF HER REQUIRING A VACCINATION.

IF WE WERE GOING TO REQUIRE A VACCINATION IS WE NEGOTIATE THE IMPACT WITH BOTH OF THE BARGAINING UNITS IN THE IMPLEMENTATION OF THE POLICY.

THE BOARD AT THIS POINT WILL HAVE THE AUTHORITY WITHOUT HAVING TOO MUCH OF THE PREVIOUS RISK TO IMPLEMENT THAT POLICY.

THE MORE INSTITUTIONS OF HIGHER EDUCATION THAT REQUIRE THIS POLICY, THE LESS LIKELY IT WILL BE CHALLENGED.

AS I SAID BEFORE, AT LEAST TWO OR ONE CAN COME TO THE STUDENTS REQUIRING A VACCINATION AND IT WAS BOTH THE FEDERAL AND SUPREME COURT AT THE JUSTICE LEVEL AND THIS WAS A MATTER OF PUBLIC HEALTH.

THEY DID NOT WANT TO GET VACCINATED.

THEY WERE AT AN INSTITUTION THAT DID NOT REQUIRE THE VACCINATION AND AT THIS TIME THERE WAS NO LEGAL PRECEDENT.

THEY SAID THAT THEY COULD NOT DO THAT.

THERE ARE SOME PRACTICAL IMPLEMENTATIONS THAT WE CAN DISCUSS AND WE CAN NAVIGATE TO THAT AND THAT WAS THE GOAL FROM THE LEGAL PERSPECTIVE BUT IS NOT A PRECEDENT AT THIS PARTICULAR POINT.

>> TRUSTEE: CAN I ALSO MENTIONED, THE CURRENT PROCESS OF PROOF OF VACCINATION OR REGULAR TESTING, IT TAKES SEVEN TO 11 DAYS FROM POTENTIAL EXPOSURE TO TEST POSITIVE.

BY US CONTINUING THE PROOF OR REGULAR TESTING, WE ARE GOING TO HAVE SITUATIONS WHERE PEOPLE ARE TESTING POSITIVE MUCH LATER ALTHOUGH THEY CAME IN WITH A NEGATIVE TEST.

IF WE LOOK AT THE NEEDS OF THE STUDENTS LESS DISRUPTION IN THEIR STUDIES I FEEL THAT BY JUST MANDATING THE VACCINATION WE ARE NOT ONLY BEING RESPONSIBLE BUT IN THE LONG RUN THE CAMPUS COMMUNITY WILL HAVE LESS, NOT SAYING ZERO BUT LESS OUTBREAKS AND MUCH LESS DISRUPTION IN THE CLASSROOM.

>> SPEAKERS: YES.

THAT IS CORRECT.

BOTH THE TESTING AND WE HAVE HAD A NUMBER OF CONVERSATIONS BASED ON OUR TESTING PROTOCOL AND WE HAVE THOSE CONVERSATIONS AT THE SENIOR LEVEL AND WE HAVE HAD THOSE CONVERSATIONS WITH THE LABOR GROUPS.

THE ONE THAT WE HAVE IS NOT NECESSARILY THE MOST EFFECTIVE WAY TO TEST.

ESSENTIALLY IT IS THE GOLDEN RULE OF TESTING AND EVEN THAT IS NOT 100 PERCENT FOOLPROOF.

IT IS 72 HOURS EVERY TIME YOU ARRIVED TO CAMPUS.

COME ON CAMPUS FOUR DAYS A WEEK AND I ONLY TEST ONE TIME 72 HOURS PRIOR TO MONDAY.

I COULD BE POSITIVE WITH A NEGATIVE RESULT BY TUESDAY.

SO, THERE ARE SOME LIMITATIONS WITH THE TESTING BUT OBVIOUSLY, THERE ARE SOME IMPLICATIONS AND WE ARE TRYING TO WORK THROUGH THOSE.

>> PRESIDENT: ANY FURTHER DISCUSSION ON TRUSTEE DR. SANDRA SALAZAR'S CONCEPT?

>> TRUSTEE: CAN I ASK A QUESTION ABOUT THE CLASSROOM DESIGNATION REQUIRED? I WANT TO KNOW HOW ARE WE GOING TO MANDATE THAT? WOULD THAT BE CHECKED BY THE PROFESSORS AND CHECKED BY YOUR VACCINATION CARD? HOW ARE WE GOING TO DO THAT AT CERRITOS COLLEGE?

>> PRESIDENT: THANK YOU.

WE HAVE A SYSTEM WHERE THE STUDENTS WILL HAVE LOGIN ACCESS IF YOU ARE VACCINATED ONCE THE UPLOADS OF YOUR VACCINATION CARDS IS CONFIRMED, WITH YOUR PFIZER VACCINATION CARD IF YOU NEED THE REQUIREMENT YOU ARE CLEARED BY THE SYSTEM EVERY TIME YOU CHECK-IN.

SO, YOU WILL GET A GREEN CODE IF YOU ANSWER THE QUESTIONS THE WAY THEY ARE SUPPOSED TO BE ANSWERED AND THAT'S IT.

THE FACULTY WHEN NO ONE ELSE WILL ASK YOU FOR ANYTHING ELSE BECAUSE YOU WILL ALSO BE CLEARED IN THE SYSTEM AND THEN YOU WILL GET YOUR WRISTBAND AND THAT MEANS YOU WILL BE AUTHORIZED TO BE ON CAMPUS.

IN FACT, WE WILL NOT CHECKING FOR VACCINATION CARDS.

WITH TESTING ITS JUST ABOUT THE SAME.

ON MONDAY MORNING LESS TO SAY WE UPLOAD MY NEGATIVE TEST AND THE SYSTEM CLEARS ME UP AND WHEN I SHOW UP TO CAMPUS I GO INTO THE CHECK-IN POINT AND I SHOW MY GREEN BADGE AND THEY GIVE ME A WRISTBAND AND THAT'S IT.

THAT WILL SHOW I AM AUTHORIZED TO BE ON CAMPUS AND I HAVE PROOF OF VACCINATION AND THEN WE WILL NOT TO DO THAT.

>> TRUSTEE: IN Q4 THAT EXPLANATION, THAT IS VERY GOOD.

I THINK IT'S A GREAT SYSTEM.

THANK YOU.

>> PRESIDENT: THIS DISCUSSION, PARTICULARLY RELATED TO TRUSTEE DR. SANDRA SALAZAR'S CONCEPT OF MODIFYING THE SECOND READING IN THE? VERY RELATED ITEMS. ALL RIGHT.

>> TRUSTEE: WOULD THAT BE SOMETHING I BRING UP IN THE SECOND READING TO MODIFY?

>> SPEAKERS: YES, THAT IS CORRECT.

>> TRUSTEE: GOT IT.

>> PRESIDENT: LET'S MOVE TO OUR CONSENT CALENDAR ITEMS. DO WE HAVE A MOTION REGARDING?

>> TRUSTEE: SO MOVED.

>> PRESIDENT: DO WE HAVE A SECOND?

>> TRUSTEE: SAID IT.

>> PRESIDENT: CAN WE GET A ROLL CALL, PLEASE.

TRUSTEE NINEL SUTHERLAND? CLERK CARMEN AVALOS? JAMES CODY BIRKEY? TRUSTEE ZURICH LEWIS? VP DR. SHIN LIU? TRUSTEE MARIANA PACHECO? TRUSTEE MARISA PEREZ? AND TRUSTEE DR. SANDRA SALAZAR? THE MOTION PASSES.

>> PRESIDENT: THANK YOU.

WITH THAT WE WILL MOVE TO OUR INFORMATION ITEMS. WE HAVE A COLLEGE COORDINATING MINUTES OF THE MEETING OF 1021 TO HAVE A MOTION?

>> TRUSTEE: SO MOVED.

>> PRESIDENT: DO WE HAVE A SECOND?

>> TRUSTEE: SECOND.

>> PRESIDENT: CAN WE ROLL CALL VOTE?

>> TRUSTEE NINEL SUTHERLAND? JAMES CODY BIRKEY? CLERK CARMEN AVALOS? TRUSTEE ZURICH LEWIS? VP DR. SHIN LIU? TRUSTEE MARIANA PACHECO? TRUSTEE MARISA PEREZ? TRUSTEE DR. SANDRA SALAZAR? THE MOTION PASSES.

>> PRESIDENT: ALL RIGHT.

WITH THAT, WE WILL MOVE TO ADMINISTRATIVE ITEMS 5.01 AND WE HAVE A SECOND READING AND CONSIDERATION OF ADOPTION: PROPOSED NEW BOARD POLICY 2905 - SARS COV-2 (COVID-19) VACCINATION AND TESTING REQUIREMENT .

DR. JOSE FIERRO WOULD YOU MIND OPENING THIS UP?

>> SPEAKERS: THANK YOU.

THANK YOU VERY MUCH JAMES CODY BIRKEY.

BEFORE YOU WE HAVE THE REVISED POLICY AND THIS IS BASED ON THE COMMENTS AND FEEDBACK THAT WE RECEIVED BY ALL OF YOU THE LAST BOARD MEETING.

FROM THE COMMITTEE MEAN VERSE BASED ON THE COMMENTS RECEIVED BY THE BOARD OF TRUSTEES AND THE POLICY WAS APPROVED BY THE COMMITTEE WITH ONLY ONE VOTE AGAINST.

IT WAS ONE PUBLIC COMMENT ESSENTIALLY AND SOMEBODY SAID THEY DID NOT AGREE WITH HAVING THAT POLICY WITH REQUIRING TESTING AND VACCINATION ON THE PREMISE THAT IT WOULD LIMIT ACCESS TO SOME STUDENTS TO HIGHER EDUCATION.

AND, THEY DID NOT BELIEVE THAT A POLICY LIKE THIS WAS BENEFICIAL FOR OUR STUDENTS.

OTHER THAN THAT, UNDER THE PUBLIC COMMENTS THE REST OF THE COMMITTEE IS ENGAGED IN ESSENTIALLY INTEGRATING THE LANGUAGE THAT WOULD ALLOW IMPLEMENTATION VIA THE ADMINISTRATIVE PROCEDURE.

THEY ARE CURRENTLY REVIEWING, WE ARE HOPING TO DO THE WORK OF THE TRUSTEES AND AT THE NEXT MEETING GET APPROVAL FOR THE PROCEDURE.[INAUDIBLE].

THERE WERE TWO MAIN PIECES WHERE FEEDBACK WAS PROVIDED AND I WANT TO MAKE SURE THAT WE HAD THE ONE FROM TRUSTEE ZURICH LEWIS AND TRUSTEE MARISA PEREZ OF THE IMPLEMENTATION OF THE POLICY THAT WE CAPTURE THE FEEDBACK DIVIDED.

THAT WAS ONE IN THE OTHER ONE WAS IN THE BEGINNING OF THE IMPLEMENTATION AND I WANTED TO MAKE SURE THAT THAT REFLECTED WHAT YOU WANTED TO SEE THEIR.

>> TRUSTEE: IS THIS THE JUNE 30, 2022?

>> SPEAKERS: YES.

>> PRESIDENT: THAT IS GOOD WITH ME.

ONE QUESTION THAT I WOULD LIKE SOME CLARIFICATION ONLINE 24 AND SAYS UNDERGO TESTING NO MORE THAN ONCE A WEEK FOR COVID-19 INFECTION.

WOULDN'T IT BE AT LEAST ONCE A WEEK AND NO MORE? BECAUSE YOU CAN GET TESTED MULTIPLE TIMES.

>> SPEAKER: YES, THAT IS CORRECT.

YES.

THANK YOU FOR BRINGING THAT UP.

THERE ARE A COUPLE OF ISSUES THAT I THINK IT WOULD BE IMPORTANT TO HEAR AND IF YOU WANTED TO ADDRESS THOSE MODIFICATIONS, THEY WILL BE FINE.

IF NOT WE CAN ADD A SIMILAR LINK WHICH SHE WHAT IS HERE.

THE FIRST ONE WE DID REGULAR BECAUSE WE ARE WAITING TO NEGOTIATE WHAT WILL REGULAR MEAN FOR THEM? WE WANT TO DEFINE THAT.

THE FEEDBACK AS I UNDERSTOOD IT LAST TIME WAS TO GO WITH FROM DISTRICT AND ONCE A WEEK.

WE CAN MODIFY THAT TO MORE THAN ONCE A WEEK AND THE CHALLENGE WE ARE SEEING WITH THAT IS, AND WE ARE WORKING TO IT WE CAN LIVE WITH IT HERE THE CHALLENGE IS THAT IF I COME TO WORK FOUR DAYS A WEEK OR TWO DAYS A WEEK THAT ARE SEPARATED LET'S SAY MONDAY OR THURSDAY.

THE TIME I COME THURSDAY AGAIN MY TEST IS LONGER THAN 72 HOURS.

WE ARE ASKING EVERYONE TO HAVE A TEST WITHIN 72 HOURS BY THE SECOND TIME I COME TO CAMPUS WHETHER I AM IN COMPLIANCE WITH THAT OF ONCE A WEEK I AM OUTSIDE OF THE WINDOW WHERE YOU CAN EFFECTIVELY SAY IT IS LIKELY THAT THIS PERSON IS NEGATIVE.

THAT IS THE CHALLENGE WE ARE HAVING AND IS SOMETHING WE CAN ALL DISCUSS.

WE'VE HAD THAT CONVERSATION OR THE CAMPUS LEADERS HAVE BEEN SAYING THAT, FACULTY IS SAYING THAT, ACME AND CONFIDENTIAL.

THEY ARE ALSO SAYING THAT THEY ARE ASKING FOR MORE OR LESS WE HAVE VOICED THE SAME CONCERN AS WE HAVE HAD TO LOOK FOR A WAY TO MAKE IT EFFECTIVELY IMPLEMENTED.

WE HAVE COME WITH A COUPLE OF DIFFERENT SOLUTIONS THAT WILL BRING US SOMEWHAT CLOSER TO THE WINDOW AND SOME PEOPLE WILL BE WITHIN THAT 72 HOURS.

>> PRESIDENT: YOUR POINT REMAINS THAT THE LANGUAGE IS UNCLEAR THE WAY THAT IS CRAFTED.

>> SPEAKER: WE CAN ADD MORE THAN ONCE A WEEK OR AT LEAST ONCE A WEEK.

>> PRESIDENT: I THINK WE CAN SAY AT LEAST ONCE A WEEK AND WE CAN PUT A SO IT PROVIDES FLEXIBILITY LIKE YOU SAID MONDAY THROUGH THURSDAY TO CERTAIN CLASSES.

>> SPEAKER: WE CAN MAKE THAT CHANGE.

THAT WILL ALSO LEAVE US THE OPPORTUNITY TO WORK WITH DIFFERENT GROUPS IN THE PROGRAM ON WHAT IS APPROPRIATE.

>> PRESIDENT: I THINK THE CORE OF THE COMMENT AT LEAST I SAW IT, TRUSTEE ZURICH

[02:20:01]

LEWIS, ON THIS EVERYONE SHALL ... UNDERGO TESTING NO MORE THAN ONCE A WEEK IT SOUNDS LIKE WE ARE BORROWING THEM FROM TESTING MORE THAN ONCE WHERE WE ARE NOT BARRING THEIR TESTS.

>> TRUSTEE: I HAD A COMMENT ON THAT SAME PARAGRAPH.

LINE 22 IS SPECIFICALLY MENTIONED ALL DISTRICT EMPLOYEES AND STUDENTS.

WE HAD A DISCUSSION ABOUT CONTRACTORS.

WHERE DO THEY FIT IN? CONTRACTORS, VISITORS, IF THERE IS A VISITOR ON CAMPUS, I DON'T KNOW IF TESTING IS A POSSIBILITY.

>> SPEAKER: YES.

SO, IT IS ACCESS TO THE BUILDING AND THIS IS COMPREHENSIVE FOR EVERYONE.

THERE ARE ONLY A COUPLE OF EXCEPTIONS AND THAT DOES NOT INCLUDE EMPLOYEES ON CAMPUS.

THEY WILL BE SUBJECT TO REGULAR PROCEDURES BUT FOR INSTANCE, AS THEY DO THE ABATEMENT HERE FOR THAT PERIOD OF TIME THE PROJECT WOULD LAST THEY WOULD BE SUBJECT TO THE TYPE OF POLICY.

VISITORS WOULD BE SUBJECT TO POLICY AND THEY WOULD HAVE TO TEST AHEAD OF TIME AND RIGHT NOW THEY WOULD DO THE NORMAL CHECK-IN PROCEDURE ON CAMPUS HERE THEY HAVE TO GO THROUGH THE QUESTIONNAIRE, GET ASSIGNED AND THAT IS ALL.

>> TRUSTEE: I WOULD REALLY LIKE TO SEE CONTRACTORS IN THIS GROUP.

I WOULD ASK FOR THAT JUST BECAUSE EVEN IF THEY ARE CONFINED TO AN AREA THEY CAN GO TO THE VENDORS, THE FOOD VENDORS AND AGAIN THEY CAN USE THE RESTROOM, AGAIN, IF WE ARE GOING TO COME DOWN, WE SHOULD HAVE EVERYONE ON CAMPUS AND THERE SHOULD BE NO EXCEPTION.

>> SPEAKER: WE DO HAVE SOME ISSUES WITH SMALL CONTRACTORS IN A SENSE, ONCE THEY ARE DOING THE ABATEMENT WE WILL PROBABLY SEE SOME PEOPLE NOT TAKE THE JOB ON SOME OF THOSE PIECES.

THEY WOULD NEED TO COVER THE COST OR SO ON AND SO FORTH AND, RIGHT NOW I HAVE A DISADVANTAGE ON THE ABILITY OF HIRING PEOPLE TO DO WORK AND MANY OF THEM ARE SAYING WELL, I'M GOING TO PICK UP ANOTHER JOB.

WE CAN OBVIOUSLY TRY TO NEGOTIATE THAT DOWN WITH THEM BUT IT MAY LEAD TO SOME COMPLICATIONS FOR THE SMALL PIECES OF WORK.

BUT, CONTRACTORS KNOW THAT THEY ARE ALMOST REGULAR HERE SO, THEY WILL BE EASY TO WORK WITH.

>> TRUSTEE: WHEN IT COMES TO THE POINT TO MAKE A MOTION I WOULD ASK THAT AND THEY HAVE 30 DAYS.

>> PRESIDENT: JUST TO CLARIFY THAT WOULD BE STARTING ONLINE 36 THE EMPLOYEES WOULD HAVE 30 CALENDAR DAYS FROM OCTOBER 31 TWO COMPLY WITH THE MANDATE AND THEY WILL BE SUBJECT TO THAT.

IT IS NOT BASED ON THEIR INDIVIDUAL FAILURE TO DO SO BUT THE CLOCK START FOR THEM OCTOBER 1 IF THEY ARE NOT VACCINATED OR COMPLIANT BY OCTOBER 31.

RIGHT?

>> SUPERINTENDENT: THAT IS CORRECT.

>> PRESIDENT: WE HAVE HAD TO SUGGESTED MODIFICATIONS.

>> TRUSTEE: I HAVE ONE MORE QUESTION ON THE LAST PARAGRAPH.

I DON'T UNDERSTAND WHAT THE VIOLATION OF THE POLICY LINE 36 THROUGH 39.

WE'LL EXPLAIN THAT? YOU EXPLAIN THAT TO ME WHAT THAT MEANS?

>> SUPERINTENDENT: SO, CODE 87732 MEANS IF I DO NOT FOLLOW ANY POLICY IT IS APPLIED TO ANY CORE POLICY I WILL BE SUBJECT TO THIS DISCIPLINARY ACTION UP TO TERMINATION.

I CAN BE PLACED ON ADMINISTERED OF LEAVE FOR INSUBORDINATION, ESSENTIALLY.

SO WHAT WE ARE DOING IS GIVING EVERYONE A 30 DAY WINDOW SO THEY CAN ADJUST TO THE PROCESS.

WE'RE NOT GOING TO PUT ANYONE ON ADMINISTERED OF LEAVE UNTIL THE 30 DAY WINDOW HAS EXPIRED.

CORRECT.

>> TRUSTEE: THAT MAKES SENSE.

WERE THERE ANY CONCERNS EXPRESSED EITHER UNION ON THAT PARAGRAPH?

>> SUPERINTENDENT: NOT REALLY.

BECAUSE WE HAVE THE BOARD OF ETHICS HERE AND THE LANGUAGE WE USED CAME FROM WANT TO SAY, WE ALL TALKED AND WE CAME UP WITH THE BEST LANGUAGE.

SO, THIS WAS A COLLABORATIVE APPROACH.

WE GOT THE FEEDBACK AND WE WORKED ON IT AGAIN WITH THE COORDINATING COMMITTEE.

SO, WE HAVE HAD THE OPPORTUNITY TO LOOK AT THE LANGUAGE.

CORRECT ME IF I AM WRONG.

>> TRUSTEE: THIS IS LYNN, IT IS OKAY AND I AM AWARE OF IT.

>> PRESIDENT: THANK YOU.

>> TRUSTEE: AGREED.

WE JUST WANT TO GET SOME CLARIFICATION AS TO TRUSTEE ZURICH LEWIS.

I KNOW YOU WANTED SOME CLARIFICATION ON THE TIMELINE AND WE ARE IN AGREEMENT AS WELL.

WE ARE IN OPPOSITION TO WHAT HAS BEEN PRESENTED TO US TODAY.

>> PRESIDENT: WE ARE CLARIFYING WITH THE TIMELINE.

THANK YOU.

OKAY.

ANY OTHER COMMENTS OR QUESTIONS?

>> TRUSTEE: YES.

I WOULD LIKE TO MAKE A MOTION TO MAKE A FRIENDLY AMENDMENT TO ADD MANDATORY VACCINATION TO THIS BOARD POLICY.

>> PRESIDENT: OKAY, WE HAVE A MOTION DO WE HAVE A SECOND?

>> TRUSTEE: SECOND.

>> TRUSTEE: I HAVE SOME QUESTIONS.

>> PRESIDENT: WHY DON'T WE OPEN UP THE DISCUSSION ON THIS.

>> TRUSTEE: I HAD A QUESTION.

I REMEMBER WHEN LA CC DID THIS THEY STARTED OFF LIKE WE DID, VACCINATION AND WEEKLY TESTING AND THEN THEY MOVED TO MANDATORY.

WHAT WAS THE REASONING BEHIND THAT MOVEMENT: AND, TWO, IF WE DO MOVE TO MANDATORY EVACUATIONS DO WE NEED TO GO BACK TO THE PROCESS AGAIN WITH THE UNION SINCE THIS IS DIFFERENT THAN WHAT IS INCLUDED IN THE POLICY TODAY?

>> SUPERINTENDENT: I HAD A CONVERSATION WITH CHANCELLOR RODRIGUEZ ABOUT THIS.

THEY DID THE SAME AND CREATED THEIR PROCEDURE VERY SIMILARLY TO OURS.

ONCE THE VACCINE BECAME FDA APPROVED THEY HAD A CONVERSATION ALONG THE LINES OF WHAT IS BEST FOR THE LONG-TERM OPERATIONAL PURPOSES OF THE INSTITUTION.

THERE IS SOME RESPONSIBILITY THAT THE BOARD HAS TO MAINTAIN PUBLIC HEALTH.

THAT IS PART OF THE BOARD POLICY AND CODE.

IT IS OUR LEGAL RESPONSIBILITY OF MAINTAINING THE BEST POSSIBLE PUBLIC HEALTH ON CAMPUS.

AT THE END OF THOSE CONVERSATIONS, THEY CONCLUDED ESSENTIALLY IT WAS AT THE BEST INTEREST OF THE DISTRICT AND THE CAMPUS COMMUNITY TO REQUIRE VACCINATIONS GIVEN THE FACT THAT THE EXPECTATION OF HAVING TO DEAL WITH SOME SORT OF FORM OF COVID-19 OVER THE LONG RUN.

THE OTHER PART IS THAT THEY WILL ALLOW TO RESUME SEMINORMAL ACTIVITIES FASTER IF WE CONTINUE WITH THE CURRENT PROCESS.

THE CURRENT PROCESS, OBVIOUSLY IS CONVENIENT.

IT PROVIDES A CHOICE BUT IT IS ALSO MORE EXPENSIVE TO RUN.

EVEN IF WE DON'T CONSIDER THE COST OF TESTING.

OPERATING HOW WE ARE CURRENTLY OPERATING IS MORE COST-EFFECTIVE.

BASED ON THOSE PARAMETERS WE DECIDED THAT LONG-TERM WAS BETTER TO REQUEST VACCINATIONS OVERALL TO INCREASE PUBLIC HEALTH AND TO OBVIOUSLY BE ABLE TO OPERATE FOR THE LONG TERM.

WHAT IS REQUIRED? OBVIOUSLY, WE COULD MAKE A MOTION AND IT DOES NOT HAVE TO GO TO THE GROUP.

BUTWE DO HAVE TO NEGOTIATE THE EFFECT AND IF THAT'S GOING TO HAPPEN I WOULD ASK THE BOARD TO ALLOW ME SOME TIME TO HAVE CONVERSATIONS WITH HOW WE CAN IMPLEMENT THESE IN A WAY THAT IS LESS DISRUPTIVE.

THE REASON I'M SAYING THIS IS THAT THERE'S BEEN A LOT OF WORK AND CONVERSATION TO TRY TO HIM MEANT WHAT THE PREVIOUS RESOLUTION SAID BY OCTOBER 1 SO WE WILL NEED SOME TIME TO BE ABLE TO ROLL OUT A VACCINE MANDATE WITHOUT DISRUPTING THE EDUCATIONAL PROCESS.

WHAT I MEAN BY THAT IS, LET'S SAY WE HAVE SOME STUDENTS ON CAMPUS THAT ARE WILLING TO TEST BUT NOT WILLING TO VACCINATE.

IF WE IMPLEMENT THAT SAY EFFECTIVE IMMEDIATELY OR NEXT WEEK AND THEY SAY I DON'T WANT TO VACCINATE, I DON'T THINK IT WILL BE WISE FOR US TO BE IN THE POSITION TO REMOVE THEM FROM CLASS ONCE THE CLASS HAS ALREADY STARTED UNDER A SPECIFIC SET OF CIRCUMSTANCES.

IT'S THE SAME THING WITH FACULTY AND STAFF.

EVENTUALLY I UNDERSTAND IT THE BOARD POLICY HAS TO BE IMPLEMENTED AND WE WILL ALL DO WHAT WE NEED TO DO TO IMPLEMENT THE THERE WAS ALSO SOME IMPLICATION THAT IF YOU COME THIS IS WHAT YOU CAN EXPECT.

I WILL ASK THE BOARD TO GIVE US A LITTLE BIT OF TIME TO WORK WITH THE GROUPS AND TO FIND THE IMPLEMENTATION THAT IS NOT DISRUPTING THE PROCESS.

BY DOING THIS WORK, IT'S NOT TO DISRUPT THE PROCESS BUT TO BE MINDFUL OF HOW WE IMPLEMENT ANYTHING ELSE.

I AM NOT SAYING THAT IT CAN'T BE DONE OR ANYTHING LIKE THAT.

I WAS SIMPLY ASK FOR A LITTLE BIT OF TIME TO FINISH THE PROCESS.

>> TRUSTEE: OKAY.

I GUESS YOU ADDRESSED SOME OF MY CONCERN AND THAT THE STUDENT.

RIGHT NOW WE HAVE A: THE DASHBOARD WHICH HAS BEEN DATED.

THE VACCINES.

WE HAVE WITHIN OUR COMMUNITY COLLEGE DISTRICT THE VACCINATION PROCESS JUNE 27 AND THIS IS A LITTLE BIT OUTDATED BUT AS MENTIONED EARLIER SOUTHEAST HAS BEEN HARDEST HIT AND THEY ARE AT A MUCH LOWER VACCINATION RATE.

SO WHILE I WOULD HUNDRED PERCENT AGREE THAT I AM CONCERNED ABOUT STUDENTS IN SOUTHEAST LA WHO HAVE CHOSEN NOT TO GET A VACCINE FOR WHATEVER REASON THEY HAVE THAT THEY WON'T BE ABLE TO CONTINUE THEIR EDUCATION NEAR AT CERRITOS COLLEGE.

SO, THAT IS THE ADDRESSING OF THE TIMING.

THERE ARE STUDENTS WHO HAVE CHOSEN TO RETURN, HOW ARE WE GOING TO IMPLEMENT A OCTOBER 1? VACCINE OR TESTING? AND THEN, THOSE VACCINES ARE OUT SO WHAT DO WE DO WITH THOSE STUDENTS? I'M GOING TO LOOK AT SOME ISSUES AND I THINK THAT WHILE THIS DEFINITELY HAS MERIT THESE ARE SOME ISSUES THAT NEED MORE TIME.

>> SUPERINTENDENT: I THINK WE CAN FIND SOME SOLUTIONS ON THOSE.

IF WE ARE GOING TO MAKE A CHANGE ON THAT, WE WOULD JUST NEED A LITTLE BIT OF TIME TO WORK THIS THROUGH SO WE DON'T CHASE OUT STUDENTS.

NOW, WHEN WE LOOK AT THE LIST OF COLLEGES, ESSENTIALLY EVERYONE IN OUR VICINITY HAS A VARIATION OF WHAT WE ARE DOING WHICH MEANS THAT NO MATTER WHERE THE STUDENTS GO TO TRANSFER IT IS GOING TO BE THE EXPECTATION.

BUT, ONE BEING IS HAVING THAT EXPECTATION IS HAVING THE RULES CHANGE HALFWAY THROUGH.

AND WHILE I KNOW THAT A LOT OF PEOPLE SAY YEAH, SURE, OTHERS WILL SAY NO AND I THINK THAT THOSE ARE OVER HERE WE SHOULD HAVE A PLAN TO ACCOMMODATE THEM AND IF WE CHOOSE TO IMPLEMENT IT RIGHT AWAY OR IMPLEMENT IT WAS STUDENTS COMING IN THE SECOND WEEK OR DO A SOFT ROLL OUT IN THE FALL AND SPRING.

YOU KNOW? DIFFERENT WAYS TO IMPLEMENT THESE IN A TIMELY MANNER AND MAINTAINING THE EDUCATIONAL PROCESS GOING FORWARD AND OBVIOUSLY KEEPING IN MIND THE SAFETY OF EVERYONE.

[02:25:01]

ALL OF THOSE CAN BE ADDRESSED AND WE HAVE A LITTLE MORE TIME TO HAVE THIS CONVERSATION.

>> PRESIDENT: TRUSTEE MARISA PEREZ DO YOU HAVE A QUESTION ON THIS TOPIC.[BLEEP] DEE I ONLY ASK BECAUSE I HAVE A COUPLE OF FOLLOW-UP QUESTIONS.

>> TRUSTEE: NO.

>> PRESIDENT: WHAT I WANTED TO ASK, DR. JOSE FIERRO, FOR THIS PIECE, THE VENDOR PIECE, IS THERE ANY PROCESS ISSUE RELATED TO LAYERING SOME OF THESE POLICIES SO THAT WE WOULD ABLE TO PASS A PRELIMINARY POLICY IN SHORT ORDER NOW? AND THEN ADD ON ADDITIONAL ELEMENTS AS YOU SEE FIT? TO BE COME BACK WITH VENDOR SPECIFIC PEER THE PUNISHMENT LAID OUT IN THIS PROPOSED POLICY IS IN REGARDS TO EMPLOYMENT AND STUDENT CODE OF CONDUCT WHICH OBVIOUSLY AN EMPLOYER DOES NOT HAVE.

FOR US TO HAVE SOMETHING THAT IS MORSE'S THING AND IS NOT DESIGNED SPECIFIC TO THAT AND WITHOUT NECESSARILY PULLING OUT THE CAMPUS PIECE OR THE CAMPUS COMMUNITY AND OR HAVING THE VACCINATION ONLY MODIFICATION CAN GO THROUGH THE GOVERNORS PROCESS OR GET MORE TECHNICAL WITH THE ROLLOUT TODAY.

THOSE ARE TWO CONCEPTUAL IDEAS AND I WANTED TO GET YOUR THOUGHTS ON THAT PROCESS.

>> SUPERINTENDENT: SO, I BELIEVE WE HAVE HAD DISCUSSIONS WITH THE VENDORS.

THE VENDORS DO NOT FALL WITHIN THIS PROTOCOL BUT THEY DO FALL IN WITH SOME OF THESE PIECES.

WE HAVE HAD MANY PLAYERS DOING WELL WITH THE MASKS, THEY HAVE NO PROBLEM WITH THAT.

WHAT WERE GOING TO HAVE TO WORK CLOSER WITH AT THIS POINT ARE THE VENDORS ON CAMPUS HAVING A HARD TIME TO STAY OPEN BECAUSE WE HAVE THE ROTATION OF THE STUDENTS.

SO, WE DO HAVE AN IDEA THERE TO BE ABLE TO CONTINUE TO WORK WITH THEM.

ESSENTIALLY, I WILL SAY THAT THE CONSEQUENCE OF NOT FOLLOWING THE PROCEDURE OF THE VENDORS, FOR US BECAUSE ESSENTIALLY WE WON'T BE ABLE TO CONDUCT BUSINESS BECAUSE OF BEING NONCOMPLIANT FOR POLICY.

>> PRESIDENT: SURE.

>> SUPERINTENDENT: WE ARE WORKING WITH THEM AND VICE PRESIDENT LOPEZ, WE HAVE HAD PROGRESS WITH THAT AND SHOULD BE ABLE TO PLUMMET, CORRECT? - IMPLEMENTS, CORRECT?

>> TRUSTEE: CONSIDERING THE CONTRACTORS, THE CHALLENGE WILL BE BECAUSE LEGALLY, IS IT OKAY IF I GO.

LEGALLY, IT IS HARD TO ENFORCE THAT BECAUSE IF FORCING A CONTRACTOR HAS TO BE VACCINATED AND THEY DON'T HAVE ANY EMPLOYEES VACCINATED THAT COULD POTENTIALLY MEAN CONSTRUCTION DELAYS WHICH IF IT WAS LEGALLY CHALLENGED IT WOULD PREVENT THAT TO DO SO BECAUSE WE HAVE IMPLEMENTED A POLICY THAT IS NOT IN THE CONTRACT.

SO, WE SHOULD CONTACT LEGAL BEFORE MAKING A DECISION ON THAT.

THAT IS SOMETHING THAT WE SHOULD LOOK AT.

WE HAVE BEEN TALKING TO A LOT OF OUR VENDORS THAT ARE CURRENTLY ON CAMPUS AND THE ONES CURRENTLY UNDER CONTRACT WILL BE THE ONES THAT ARE GOING TO BE MORE CHALLENGING.

SO, THE LEGAL RAMIFICATION THAT WE HAVE COULD BE AGAINST US SO WE ARE OBLIGATED TO FULFILL THE CONTRACT.

WE ARE IMPLEMENTING BARRIERS THAT ARE NOT NECESSARILY IN THE CONTRACT AND WE COULD BE CHALLENGED THAT.

>> PRESIDENT: UNDERSTOOD.

IF I CAN SEPARATE OUT AGAIN, THE CORE OF MY QUESTION IS LESS ABOUT THE IMPLEMENTATION AND THE RESULT OF POLICY BUT A LITTLE MORE LIKE THE PROCESS INSTEAD OF COMPILING THESE TWO OTHER ISSUES INTO THE POLICY WE ARE CONSIDERING TODAY WHICH IS PROTOCOL AROUND VENDORS AND VACCINATIONS.

IF WE WERE TO HAVE THOSE EITHER SEPARATE OR ADDED ON AT A LATER DATE WITH THAT BE PROBLEMATIC?

>> SUPERINTENDENT: NUMBER I THINK WE COULD COME BACK WITH SOMETHING REGARDING THE CONTRACTORS AND VENDORS HEARD WE COULD COME BACK WITH THAT.

IF YOU WANTED TO CAN THAT ARE THE RAMIFICATION ON THE VACCINATION VERSUS VACCINATION TESTING WE COULD DO SUNSET TESTING AND THAT WILL GIVE US TIME TO EITHER COME TO YOU WITH WHAT WE ARE GOING TO DO WITH SUNSET OR SIMPLY ASK FOR AN EXTENSION OF THE TESTING IF THAT WAS POSSIBLE.

FOR INSTANCE, WE COULD DO SOMETHING TO SAY TESTING WILL BE DECEMBER 31 2020 FOUR FULL VACCINATION WILL BE EFFECTIVE JANUARY 1.

DURING THAT PERIOD OF TIME WE COULD PUT THE PROCESS BACK TO YOU AND NINE SOMETHING WE CAN LIVE WITH, SUNSET, EXPIRES AND THEN WE ROLL INTO THE NEXT YEAR WITH THE VACCINATION ONLY REQUIREMENT AND IF THAT DOES NOT WORK OBVIOUSLY WE WOULD COME TO YOU AND SAY WE CAN GO BACK TO EXTEND THIS, OR SOMETHING TO THAT EXTENT.

WE COULD DO SOMETHING LIKE THAT, TO MODIFY IT AS A SEMESTER, AS THE SEMESTER PROGRESSES.

>> PRESIDENT: AND WE NEED TO FIGURE OUT HOW TO ATTACK THE VENDOR SITUATION BECAUSE WE HAVE SO MANY DIFFERENT TYPES AND COULD BE DIFFERENT DEPENDING ON THE VENDOR AND THE CONTRACT.

IT WARRANTS AN ADDITIONAL STUDY THAT MIGHT BE VALUABLE TO LOOK AT SEPARATE AND HOW WE MOVE FORWARD WITH THIS TO CREATE THE SAME OUTCOME FROM A TECHNICAL STANDPOINT IT MIGHT BE HELPFUL TO SEPARATE THIS OUT.

>> SUPERINTENDENT: WE CAN DO THAT.

>> PRESIDENT: WHICH BRINGS US TO THEN, WE CAN DISCUSS THIS FURTHER BUT I DON'T WANT TO DEPART ON TRUSTEE DR. SANDRA SALAZAR'S MOTION PARTICULARLY RELATED TO ADDING THE VACCINE REQUIREMENT AS THE ONLY REQUIREMENT AND AT LEAST AT SOME POINT TRUSTEE DR. SANDRA SALAZAR, DO YOU HAVE SOME FURTHER INPUT ON WHAT HAS BEEN DISCUSSED IN REGARDS TO PHASING IN OF THE VACCINE REQUIREMENT AND OVERTIME TRYING TO DO IT EFFECTIVELY?

>> TRUSTEE: YES.

I WANTED TO CLARIFY, MY GOAL IS NOT TO EXCLUDE ANYONE WHETHER IT BE AN EMPLOYEE OR A STUDENT.

AS DR. JOSE FIERRO SAID, WE DO HAVE AN OBLIGATION TO PUBLIC HEALTH.

THAT IS WHERE I AM COMING FROM.

THE CONCERN IS CAMPUS COMMUNITY AND THEIR HEALTH AND WELL-BEING.

I AGREE WITH DR. JOSE FIERRO.

IT WILL TAKE TIME TO IMPLEMENT.

I SEE THAT HE STEPPED AWAY BUT WANTED TO ASK HIM IF WE WOULD HAVE A BALLPARK TIMEFRAME.

I DON'T MIND DOING A ROLLOUT AND DOING A SUNSET, I AM IN FAVOR OF THAT.

I KNOW THAT THINGS ARE NOT DONE IN AN IMMEDIATE MATTER.

I AM WONDERING IF DR. JOSE FIERRO COULD GIVE US A ROUGH BALLPARK IF WE COULD DO A SUNSET AND THEN HOW MUCH TIME HE THINKS HE MIGHT NEED TO DO THE MANDATORY ONLY.

>> SUPERINTENDENT: I WOULD START THE CONVERSATION WITH OUR GROUP TOMORROW WE HAVE A MEETING AND WE CAN BEGIN THE CONVERSATION THERE.

I WILL SAY I WILL ADVISE TO MAKING AN IMMEDIATE IMPLEMENTATION ON THE STUDENTS THAT ARE CURRENTLY ENROLLED BECAUSE I DO KNOW THAT I DON'T WANT TO PROVIDE THE STUDENT WITH A WAY TO NOT ATTEND COLLEGE AT THAT POINT.

>> PRESIDENT: THE QUESTION IS HOW LONG IT WILL TAKE?

>> SUPERINTENDENT: I THINK THE STUDENTS COULD BE DONE AND IT WILL BE PARTIAL, WOULD BE FOR THE SECOND NINE WEEKS AND I'LL HAVE TO DOUBLE CHECK THE SCHEDULES ON THAT.

IDEALLY IF THE BOARD WAS GOING TO CONSIDER THIS I WOULD SAY THEY ARE PUTTING IN A SOFT IMPLEMENTATION NOW AND AN ACTUAL COMPLIANCE BY THE FIRST OF 2022.

THAT WOULD BE APPROPRIATE AND WILL GIVE US ENOUGH TIME TO WORK WITH EVERYONE.

WHAT I MEAN BY A SOFT IMPLEMENTATION IS WE DO SOMETHING TO ENCOURAGE EVERYONE TO GET VACCINATED IN THIS TIME.

PROVIDE A TESTING OPTION, AS WE TRANSITION.

BUT IF THE POLICY COULD SAY SOMETHING THAT TESTING WILL ONLY BE ALLOWED UNTIL DECEMBER 31, 2021.

VACCINATION ONLY BEGINNING JANUARY 1.

THAT WILL GIVE US ENOUGH TIME TO DO SOME SORT OF INCENTIVE FOR PEOPLE TO DO THAT AND FOR PEOPLE TO MAKE AN INFORMED DECISION OF THE NEXT STEPS.

>> TRUSTEE: I WOULD ALSO LIKE TO ADD THAT FLU SEASON IS STARTING AND AS WILL GO AS IT GETS COLDER AND PEOPLE ARE MORE INDOORS WE MIGHT SEE AN UP TICK OF CASES IN CONFUSION WITH THE FLU SEASON.

DR. JOSE FIERRO I AM OPEN TO YOUR GUIDELINES AND YOUR GUIDANCE TO HOW THAT WILL WORK.

MY QUESTION IS, DO WE NEED TO GO NOW AND LOOK AT SOMETHING LIKE THAT OR WHAT WOULD YOU SUGGEST?

>> SUPERINTENDENT: MY SUGGESTION IS IF YOU ARE GOING TO MAKE A MODIFICATION THIS IS THE TIME TO DO IT SO WE CAN HAVE SOME DIRECTION AND HAVE CONVERSATION TO BE ABLE TO DEVELOP A WAY TO GET TO FULL IMPLEMENTATION COMING AT THE FIRST OF THE YEAR.

>> PRESIDENT: WOULD YOU SUGGEST ADDING THAT INTO THIS PROTOCOL TODAY OR HAVING IT SEPARATELY?

>> SUPERINTENDENT: WHAT I WOULD SUGGEST IS IN MODIFYING THAT LANGUAGE THE TESTING WILL ONLY BE ALLOWED AND PROVIDED UNTIL THE END OF THE YEAR OR DECEMBER 31, 2021 AND THEN ASKED THAT VACCINATION ONLY WILL BE REQUIRED.

SOMETHING LIKE THAT.

>> TRUSTEE: I WAS JUST DOING SOME RESEARCH ON WHAT LA CC DID AND IT LOOKS LIKE AUGUST 4 IS WEDNESDAY REQUIRING A VACCINATION OR TESTING AND TODAY THEY ARE APPROVING MANDATORY.

THEY HAVEN'T PROVED IT YET.

FOR THEM THEY HAVE REVISED IT A MONTH LATER.

WHAT I AM THINKING IS WHAT EXCLUSION, WHY DON'T WE JUST APPROVE THE POLICY TODAY AND THEN YOU CAN COME BACK WITH A DRAFT APPEARED BASICALLY THEY AMENDED POLICY TO 900 AND SUPERSEDED IT WITH THE MANDATORY VACCINATION.

TO MAKE IT CLEAR AND CLEANER AND TO BE LESS CONFUSED IT MIGHT BE A BETTER OPTION.

>> SUPERINTENDENT: YES, WE CAN DO THAT.

THE ONLY REASON I'M SUGGESTING TO MAKE THE AMENDMENT IS THAT WILL GIVE US THE TIME TO BEGIN WORKING.

THE LONGER IT TAKES TO MAKE A DECISION THE SHORTER THE TIMELINE TO IMPLEMENT THIS.

SO, I'M JUST ASKING FOR TIME TO HAVE THIS CONVERSATION AND DO THE BACKGROUND WORK.

>> PRESIDENT: SOUNDS LIKE, TRYING TO UNDERSTAND CORRECTLY, DO YOU NEED US TO MAKE A MODIFICATION TO THIS FROM A PROCEDURAL STANDPOINT OR ARE YOU COMING TO US WITH A RECOMMENDATION ON THE ROLLOUT?

>> SUPERINTENDENT: IT WILL BE MY PREFERENCE IF YOU WILL PROVIDE US WITH ERECTION TODAY TO EITHER MAKE THE MODIFICATION ON A TESTING EXPIRING AT THE END OF THE YEAR OR IF WE CONTINUE WITH THE SELECTION AS STATED IN THE POLICY.

WE DO HAVE SOME TIME BUT THE MORE TIME YOU GIVE US TO IMPLEMENT THE BETTER AND WE CAN COME WITH A PROCEDURE FROM THE CONVERSATION WE HAVE WITH CAMPUS COMMUNITY.

>> PRESIDENT: I THINK IT'S GOOD.

ONE THING WERE TRYING TO BE RESPONSIBLE AND RESPECT OF IS HOW WE CAN BE INCLUSIVE IN THE CONVERSATION.

WE NEED TO MODIFY THIS AND RATHER THAN JUST ADOPTING IT TODAY AND MODIFYING ADDITIONAL ELEMENTS OR POLICIES AS NEEDED ONCE THEY WORK THEIR WAY THROUGH THE POLICY.

>> TRUSTEE: I THINK I WOULD PREFER TO ADOPT IT CLEAN TONIGHT AND GIVE YOU VERBAL DIRECTION.

WHETHER THAT IS THE FIRST DRAFT, AND YOU MEET WITH UNIONS TOMORROW, WE NEED TO MEET WITH THE STUDENTS AS WELL, TOO.

THIS GREATLY IMPACTS THE STUDENTS.

[02:30:01]

TO MAKE IT CLEAR AND CLEANER, I MOVED TO ADOPT THE RESOLUTION IN THE POLICY AS PRESENTED BY STAFF AND GIVE YOU SOME DIRECTION WITH AN AMENDED POLICY ADDRESSING THE MANDATORY VACCINATION WITH VENDORS AND CONTRACTORS.

>> PRESIDENT: WE WILL WITHDRAWAL THAT DIRECTION.

JUST TO THIS POINT BECAUSE THE UNDERSTANDING OF WHETHER OR NOT THIS WORKS.

>> SUPERINTENDENT: WE WILL MAKE IT WORK IN ANY DIRECTION YOU PROVIDE.

THE ONLY THING I AM ASKING IS FOR TIME.

IF YOU DECIDE TO CHANGE THIS WILL BE A PERFECT TIME TO IMPLEMENT I THEN.

BY 2022 AND THAT IS THE, MY ONLY ASK.

WE COULD GO EITHER WAY.

>> TRUSTEE: WE CAN APPROVE THIS POLICY AND THEN YOU WORK ON THE OTHER THING AND THEN ON THE REVISION IT WILL SAY IT DOES NOT GO INTO EFFECT BUT IF WE COULD REVISE IT WE COULD GO UNTIL 2022 AND THAT WOULD GIVE YOU SUFFICIENT TIME TO WORK ON ANY POLICY.

I DO NOT THINK IT WOULD BE FAIR FOR STUDENTS WHO HAVE ALREADY STARTED TO ALL OF A SUDDEN CHANGE EVERYTHING ON THEM.

I THINK WE DO NEED SOME TIME TO COME UP WITH A REASONABLE SOLUTION WITH ALL PARTIES INVOLVED.

THE STAFF, THE STUDENT UNIONS AND HOW TO IMPLEMENT.

>> TRUSTEE: DR. JOSE FIERRO, IN FAIRNESS TO YOU I WANT TO MAKE SURE YOU HAVE THE TIME YOU NEED TO IMPLEMENT SOMETHING LIKE THIS BECAUSE YOU ARE RIGHT, YOU HAVE TO HAVE A CAMPUS CAMPAIGN YOU NEED TO MAKE SURE EVERYONE IS AWARE ON CAMPUS IF THIS GOES INTO EFFECT AND WIN.

I WANT TO MAKE SURE, I AM OKAY WHETHER IT IS AN AMENDMENT OR NOT AND WHETHER IT COMES BACK.

I JUST WANT TO MAKE SURE THAT WE START WORKING ON THIS AND WHETHER OR NOT THE BOARD IS IN FAVOR TO MOVE IN THIS DIRECTION AS WELL.

I DON'T KNOW IF WE NEED TO TAKE A BOAT TO GIVE YOU THAT DIRECTION OR IF THIS IS ENOUGH TO MOVE FORWARD AND COME UP WITH A TIMELINE.

>> SUPERINTENDENT: MAY I MAKE AN ADDITIONAL SUGGESTION? THE NEXT BOARD MEETING IS SEPTEMBER 15.

IF I AM HEARING CORRECTLY, THERE IS AN INTEREST OF THE BOARD TO HAVE THIS AMENDED.

IT COULD POTENTIALLY BEGIN MANDATORY VACCINATIONS ON JANUARY 22, IF I AM HEARING THAT CORRECT COULD I SUGGEST TO NOT TAKE A POSITION ON THE BOARD POLICY TONIGHT AND PROVIDE ME THE NEXT WEEK AND AND A HALF OR SO TO MAKE A MODIFICATION TO THE POLICY TO SUNSET THE TESTING POLICY WITH OUR GROUP AND THEN BRING IT TO YOU ON THE 15TH SO YOU VOTE.

>> PRESIDENT: I THINK THAT IS FINE.

WHAT I AM SENSING IS IN GENERAL YOU WOULD LIKE US TO ARM YOU WITH A POLICY THAT WE CAN BUILD ON.

SO THAT ON THE 15TH WE HAVE SOMETHING IN PLACE? OKAY.

[LAUGHTER] OKAY.

WITH THAT UNDERSTOOD, I WILL READ WHAT I THINK IS UNDERSTOOD, REPEATING YOUR WORDS TO SOME EXTENTS, DR. JOSE FIERRO.

ON THE 15TH WE WILL HAVE A CONSIDERATION OF AN AMENDED POLICY ON THE COVID-19 PROTOCOLS.

AND THEN WE CAN DEBATE THAT AT THAT TIME.

IS IT STILL AND AMENDMENT ON THE TABLE? WITH THAT BEING SAID, THANK YOU TRUSTEE ZURICH LEWIS, WOULD TRUSTEE DR. SANDRA SALAZAR, WOULD YOU LIKE TO CONSIDER WITHDRAWING YOUR MOTION?

>> TRUSTEE: YES I WILL WITHDRAWAL MY MOTION WITH DR. JOSE FIERRO BRINGING BACK A MOTION AT THE NEXT MEETING.

>> PRESIDENT: ALL RIGHT.

WITH THAT, WE, DO WE HAVE A MOTION TO ADOPT THIS NEW BOARD POLICY THAT IS WRITTEN WITH THE ONE MODIFICATION SUGGESTED BY TRUSTEE ZURICH LEWIS? THAT WOULD BE GREAT.

[INDISCERNABLE] >> TRUSTEE: THERE HAS BEEN A LOT OF BACK-AND-FORTH SO I AM A LITTLE CONFUSED ABOUT THE AMENDMENT AND THE MOTION SO IF WE COULD GET SOME CLARITY.

>> SUPERINTENDENT: YES.

THE MOTION IS TO APPROVE BOARD POLICY FEBRUARY 9, 2005 AS PRESENTED WITH ONE MODIFICATION IN LINE 24.

CHANGING TESTING NO MORE THAN ONCE A WEEK TO TESTING AT LEAST ONCE A WEEK.

>> PRESIDENT: THE PREVIOUS READING READ NO MORE THAN ONCE.

>> TRUSTEE: THAT IS WHAT WE ARE VOTING ON RIGHT NOW THE STAFF RECOMMENDATION.

>> PRESIDENT: DO WE HAVE A MOTION FOR THAT?

>> TRUSTEE: SO MOVED.

>> PRESIDENT: DO WE HAVE A SECOND?

>> TRUSTEE: SECOND.

ANDREA CAN WE GET A ROLL CALL VOTE UNLESS THERE IS ADDITIONAL DISCUSSION? I SEE NONE CAN WE GET A ROLL CALL VOTE.

TRUSTEE NINEL SUTHERLAND? CLERK CARMEN AVALOS? JAMES CODY BIRKEY? TRUSTEE ZURICH LEWIS? VP DR. SHIN LIU? TRUSTEE MARIANA PACHECO? TRUSTEE MARISA PEREZ? TRUSTEE DR. SANDRA SALAZAR? THE MOTION PASSES.

>> PRESIDENT: ITEM 5.02 REQUESTED BY TRUSTEE LEWIS: CONSIDERATION OF ADOPTION OF RESOLUTION #0818A EXPRESSING A VOTE OF NO CONFIDENCE IN LOS ANGELES COUNTY DISTRICT ATTORNEY GEORGE GASCON.

I BELIEVE WE HAVE A BIT OF A PRESENTATION IN REGARDS TO SOME ITEMS THAT WE MENTIONED LAST TIME.

DR. JOSE FIERRO WHEN WE HAD THIS LAST ITEM THE BOARD WANTED TO GET THE OPINION OF OUR COMMUNITY IN PARTICULAR THE CERRITOS COLLEGE CAMPUS POLICE AND IT IS MY UNDERSTANDING THAT WE HAVE RECEIVED A LETTER IN SUPPORT OF THE RESOLUTION.

>> SUPERINTENDENT: THAT IS CORRECT.

IN THIS CONVERSATION LAST TIME THIS ITEM WAS POSTPONED.

AND, SPEAKING PARTICULARLY WITH OUR CHIEF OF POLICE I HAD THE OPPORTUNITY TO MEET WITH CHIEF MILLER AND TO RECEIVE A LETTER SUMMARIZING HIS POSITION ON THE RESOLUTION.

HE IS IN SUPPORT OF THE RESOLUTION OF A VOTE OF NO-CONFIDENCE AGAINST LOS ANGELES COUNTY DISTRICT ATTORNEY GEORGE GASCON BECAUSE HIS POLICIES DO NOT SUPPORT THE DIRECTION OF DIVERSITY, EQUITY AND INCLUSION THAT CERRITOS COLLEGE SUPPORTS.

SOME OF THE POLICIES ON THE ABILITY TO PREDICATE AND ARREST INDIVIDUALS ON CAMPUS WOULD PREVENT US FROM MAINTAINING CAMPUS SECURITY IN A WAY IT SHOULD BE.

AND, ESSENTIALLY, THERE HAS TO BE A TIE FOR VIOLATORS WHO DO BREAKING AND ENTERING, DRIVING WITHOUT A LICENSE, PARKING LOTS OR COMMUNITY.

THEY CANNOT PROSECUTE THESE INDIVIDUALS FOR VARIOUS SAFETY REASONS ON OUR CAMPUS.

IT IS IMPORTANT TO SAY THAT CHIEF MILLER IS CURRENTLY INVOLVED IN CHANGING THE FACE OF THE CERRITOS COLLEGE POLICE DEPARTMENT.

HE IS VERY INVOLVED WITH THE COMMUNITY AND SUPPORT STUDENTS.

HE IS VERY ACTIVE ON THE TRAINING OF DIVERSITY, EQUITY AND INCLUSION.

SO, I DO FEEL THAT HIS POSITION HERE COMES FROM A PLACE OF WHAT IS BEST FOR THE CAMPUS AND WHAT IS BEST FOR THE DEPARTMENT TO MAINTAIN THE SAFETY OF OTHER STUDENTS.

>> TRUSTEE: THANK YOU.

AN ADDITIONAL DISCUSSION ON THIS, I KNOW WE HAD A NUMBER OF FOLKS TALKING ABOUT THIS AT THE LAST SESSION.

>> TRUSTEE: I REALIZE THAT A VOTE OF NO-CONFIDENCE, YOU ARE SAYING YOU DO NOT AGREE WITH THIS POLICY, HE SAYING THAT IT DOES NOT PUT US IN A POSITION THAT CHANGES ANYTHING FOR US.

WHAT NEEDS TO GET DONE IS THAT THE VOTERS FEEL HE IS DOING SOMETHING THAT HE IS AGAINST OUR SAFETY OR THE SAFETY OF OTHERS, SHOULD WE RECALL HIM AND GET HIM OUT OF THE POSITION? SO THEN THAT CAN CHANGE.

I DO NOT AGREE IN THE VOTE OF NO-CONFIDENCE BECAUSE I SEE IT NOT MAKING IT TO THE CAMPUS ITSELF.

ALL WERE DOING IS SAYING WE DON'T AGREE WITH THE POLICY AND STILL WE WILL BE IN THE SAME POSITION.

IF THEY ARREST SOMEONE, IT STILL NEEDS TO GO TO THE SHERIFF, GO TO THE DA AND THIS VOTE OF NO-CONFIDENCE WON'T CHANGE THE FACT THAT WHATEVER IS GOING ON ON CAMPUS THAT THEY ARE BEING ARRESTED FOR OR BEING SENT OVER FOR PROSECUTION, THEY'RE NOT GOING TO GET PROSECUTED.

IF HE IS NOT DOING HIS JOB AND WE FEEL HE IS NOT DOING HIS JOB WE SHOULD GET HIM OUT OF OFFICE AND THAT'S THE ONLY WAY IT IS GOING TO CHANGE.

WE NEED TO CREATE A POLICY.

IT IS THE RESIDENT OF LA COUNTY THAT NEED TO VOTE HIM OUT.

THAT IS MY OPINION.

I DON'T SEE IT DOING ANYTHING FOR US BECAUSE WE ARE STILL IN THE SAME SITUATION.

IT'S NOT THAT I AGREE WITH WHAT HE IS DOING BECAUSE I DON'T.

IT'S JUST THAT I DON'T SEE THIS PUTTING US IN A POSITION WHERE IT IS GOING TO CHANGE.

>> PRESIDENT: THANK YOU TRUSTEE MARIANA PACHECO.

OTHER TRUSTEES?

>> TRUSTEE: I WAS GOING TO WAIT FOR MY COLLEAGUE TRUSTEE ZURICH LEWIS BUT I'M GOING TO GO AHEAD AND SPEAK.

I THINK I DISAGREE WITH THIS.

I THOUGHT THAT SHOULD HAVE GIVEN US MORE DISCUSSION BECAUSE I DON'T THINK IT IS OUR PLACE.

RECOGNIZING THAT WE DID GET A LETTER FROM THE CHIEF OF POLICE ON CAMPUS, RECOGNIZING THAT MANY OF THE LOCAL ENFORCEMENT AGENCIES ARE AGAINST THIS PERSON BECAUSE OF THE POLICIES PUT US IN A DIFFICULT POSITION.

I APOLOGIZE, I DON'T THINK WE SHOULD ASK THAT.

I THINK WE ARE PUTTING THE POLICE IN A POSITION THAT THEY SHOULD NOT BE PUT IN, QUITE FRANKLY AND I DON'T THINK IT WAS FOR US TO DO THIS.

I DON'T AGREE WITH THE STIGLER RESOLUTION BECAUSE AGAIN, AS MY COLLEAGUE STATED THIS IS UP TO THE VOTERS.

WHETHER WE DISAGREE OR AGREE.

WE COULD HAVE A RECALL ELECTION BUT WE SHOULD NOT INTERVENE FOR THE VOTERS HAVE AN OPPORTUNITY TO CHANGE THAT.

I THINK IT NEEDS TO GO BACK TO WHERE IT STARTED COULD MAKE THIS ELECTION AND CHOOSE WHO WE PUT IN OFFICE AT THE VOTING BOX.

I'M NOT GOING TO INFRINGE ON THAT RIGHT WHETHER I AGREE OR DISAGREE.

I AM GOING TO HAVE TO VOTE THIS RESOLUTION DOWN ON MY CONSCIENCE ALONE.

THIS COLLEAGUE HAS BEEN A TRAILBLAZERS WITH PROGRAM ONE OF BEING OUR COLLEGE PROGRAM IN THE NATIONAL RECOGNITION.

I THINK THAT WE HAVE SOME PROGRAMS THAT CONTINUE TO CHALLENGE THE SYSTEM THAT HAS IMPLEMENTED, I THINK, THE SITUATION THAT WE ARE CURRENTLY IN WHICH IS NOT PROVIDING OPPORTUNITIES TO STUDENTS, NOT AFFORDING THEM AN OPPORTUNITY TO REDEEM THEMSELVES IN SOCIETY WHATEVER THAT MEANS.

I DO THINK THAT MOVING FORWARD WITH THIS RESOLUTION, OR SENDING A MESSAGE TO OUR OWN STUDENTS THAT YOU DON'T DESERVE A SECOND CHANCE.

SO, ON THOSE GROUNDS I AM GOING TO VOTE THIS DOWN AND SAY I AM NOT GOING TO SUPPORT IT.

IT WOULD BE GOING AGAINST ANYTHING WE STAND FOR AS A PROGRESSIVE COLLEGE.

AND SO, I AM GOING TO VOTE THE SOUND.

>> PRESIDENT: OKAY.

MR. LEWIS?

>> TRUSTEE: THIS BOARD IN PAST YEARS HAS VOTED IN FAVOR OF RESOLUTIONS, THE

[02:35:02]

ABC SCHOOL BOARD BOND BALLOT IN FAVOR OF ASKING VOTERS, SOME OF WHOM DO NOT NECESSARILY LIVE IN THE CERRITOS COLLEGE DISTRICT, ASKING ALL OF THEM TO VOTE IN FAVOR OF TAXING THEMSELVES MORE FOR THEIR PROPERTY TAX IN ORDER TO FUND OUR SCHOOLS.

WITH ALSO TAKEN RESOLUTIONS AND SUPPORT OF THE PASSAGE OF DOCCA.

WE TAKE THE RESOLUTIONS INCLUDING THOSE TO THAT NOT EXACTLY CHANGE THE LAW HERE AT CERRITOS COLLEGE AND AGREE OR DISAGREE ON CERTAIN TYPES OF ISSUES THAT IS A PRECEDENT OF THIS BOARD AND THAT IS WHAT WE HAVE SAID IN YEARS PAST AND I BELIEVE THAT THIS IS NO DIFFERENT THEN SOME OF THOSE RESOLUTIONS THAT OUR BOARD HAS TAKEN AND I THINK A LOT OF MEMBERS OF OUR COMMUNITY WOULD BE SUPPORT OF THIS RESOLUTION BECAUSE MR. GASKELL HAS NOT GIVEN OUR COMMUNITY THE SECOND CHANCE.

HE IS NOT EVEN THAT OPPORTUNITY FOR THE SAFETY OF OUR COLLEGE IN PARTICULAR THE SAFETY OF OUR CITY BY NOT PROSECUTING MISDEMEANORS.

HE HAS NOT ALLOWED FOR THE DIVERSITY, EQUITY AND INCLUSION AS OUR OWN CHIEF MENTIONED WITH THE REFUSAL TO STOP A CRIME AGAINST THE LGBTQ+ COMMUNITY OR PEOPLE OF COLOR.

CRIME ENHANCEMENTS WHETHER THEY BE HATE CRIME, GANG OR OTHERWISE ARE NOT GOING TO BE A PART OF THIS POLICY.

IF YOU WANT TO TALK ABOUT SECOND CHANCES OR FIRST CHANCES, I THINK THAT MR. GASCON'S POLICY HAS BEEN SHOWN BY A NUMBER OF LAW ENFORCEMENT OFFICERS HAVE SHOWN THE DATA OF THE INCREASE IN CRIME IN LOS ANGELES COUNTY BECAUSE OF THESE POLICIES AND I THINK IT IS EXTREMELY CLEAR THIS IS A RESOLUTION WE SHOULD SUPPORT FOR THE SAFETY OF OUR COLLEGE IN PARTICULAR AND I ASKED MR. MUELLER, CHIEF MUELLER RATHER ABOUT THE IMPLEMENTATION OF MR. GASCON'S POLICIES AND HOW IT DIRECTLY AFFECTS CERRITOS COLLEGE COMMUNITY.

IN PARTICULAR I WANT TO QUOTE THAT HE SAYS, OUR OFFICERS WILL POTENTIALLY NO LONGER BE ABLE TO REMOVE HOMELESS INDIVIDUALS FOR TRESPASSING OR EVEN HOMELESS ENCAMPMENT FROM OUR CAMPUS CREATING SERIOUS HEALTH AND SAFETY ISSUES.

THE CRIMINAL THREATS THAT MIGHT BE MADE BY ANGRY STUDENTS TOWARDS FACULTY AND STAFF WILL GO UNABATED.

THERE ARE NO LEGAL REPERCUSSIONS BECAUSE THEY CANNOT BE PROSECUTED FOR A NUMBER OF REASONS INCLUDING AS HE GOES ON, FOR DRUNKENNESS, NARCOTICS, CREATING A DANGEROUS AND UNSAFE SPACE FOR OUR CERRITOS COLLEGE FAMILY.

WE WANT TO TALK ABOUT SAFE SPACES AND THIS IS SOMETHING THAT GOES TO THE VERY CORE OF HOW WE CAN HAVE A CIVILIZED AND FUNCTIONING COLLEGE MUCH LESS A SOCIETY.

IF YOU DO NOT HAVE PUBLIC SAFETY AND SUPPORT OF OUR STUDENTS, I AM NOT SURE HOW WE CAN HAVE A COLLEGE IN THE FIRST PLACE.

WHILE THIS RESOLUTION DOES NOT CHANGE THE LAW WHILE THE RESIDENTS OF LOS ANGELES COUNTY ARE CURRENTLY IN THAT PROCESS OF RECALLING THIS DISTRICT ATTORNEY, WE CAN TAKE A STANCE IN WE CAN SHOW LEADERSHIP IN OUR COMMUNITY COLLEGE HERE BY SUPPORTING THIS RESOLUTION AND MAKING IT KNOWN THAT THE POLICIES THAT OUR DISTRICT ATTORNEY MOVED FORWARD ON WERE NOT HONEST OF CHIEF MUELLER'S WORDS, WAS NOT HONEST OF MR. GASCON WHEN HE CAMPAIGNED AND TOOK OFFICE.

I THINK WE NEED TO AS A BOARD AND MANY OTHER CITIES AND ONE OTHER SCHOOL DISTRICT HAS DONE, TAKE A STRONG STANCE IN FAVOR OF COMMUNITIES THAT ELECTED US IN THE ONE THAT WE OVERSEE HERE AT CERRITOS COLLEGE.

>> PRESIDENT: THANK YOU FOR THAT RESPONSE.

ANY OTHER TRUSTEES THAT WOULD LIKE TO HAVE A FINAL DISCUSSION BEFORE WE MOVE FORWARD?

>> TRUSTEE: I WOULD LIKE TO ADD TO THE CONVERSATION JUST TO CHIME IN ON SOME OF THE COMMON.

IN RECOGNIZING THAT WE WOULD HAVE, WHETHER THE RESOLUTIONS ARE ADOPTED IN SUPPORT OF INCREASING OPPORTUNITIES FOR CLASSROOM FACILITIES, ALL THOSE ARE POSITIVE BUT WHEN I THINK ABOUT OUR COLLEGE CAMPUS ISSUES WE HAVE ON CAMPUS ARE NOT AS WIDESPREAD AS THE ISSUES WE HAVE IN THE CITY.

FOR ME WHEN I THINK OF A HOMELESS PERSON COMING ON CAMPUS I IN WONDERING IS THAT PERSON COMING TO REGISTER? IS THAT INDIVIDUAL LOOKING TO CHANGE THEIR LIFESTYLE? WE JUST ADOPTED AND SUPPORTED HOUSING FOR HOMELESS STUDENTS.

SO WHEN YOU SAY HOMELESS, I TAKE OFFENSE TO THAT BECAUSE SOME OF THEM ARE OUR STUDENTS.

OBVIOUSLY YOU'RE NOT LOOKING AT THE DEMOGRAPHICS BECAUSE IF YOU ARE YOU WOULD KNOW THAT WHEN HE PERCENT OF OUR STUDENTS ARE HOMELESS.

I DO TAKE OFFENSE TO THAT COMMENT APPEARED WE SHOULD LOOK AT SUPPORTING POLICIES THAT SUPPORT STUDENTS AND I DON'T THIS RESOLUTION SUPPORTS THE STUDENTS.

I THINK IT IS THE OPPOSITE.

THIS COLLEGE PROGRAM IS A PERFECT EXAMPLE OF THE THINGS THAT WE LOVE AND I DON'T THINK THAT IS SUPPORTING A RESOLUTION THAT DIMINISHES THOSE OPPORTUNITIES FOR OUR STUDENTS.

IT IS NOT GOING TO HAVE A POSITIVE IMPACT WHO WE HAVE SO MANY STUDENTS THAT ARE DROPPING OUT.

I THINK STATEWIDE WE'VE SEEN A DECREASE IN STUDENT ENROLLMENTS.

I THINK IF WE CONTINUE TO MOVE IN THIS FASHION AND MOVE FORWARD WITH THIS RESOLUTION IT SINCE A NEGATIVE MESSAGE TO OUR STUDENTS.

AGAIN, I AM NOT GOING TO SUPPORT THAT.

I THINK EVERY OTHER RESOLUTION THAT WE HAVE APPROVED AS A BOARD HAS BEEN RIGHT ON TARGET AND INCREASED OPPORTUNITIES FOR STUDENTS BUT THIS IS NOT IT.

>> PRESIDENT: ANY OTHER COMMENTS?

>> TRUSTEE: IF I MAY RESPOND TO WHAT CLERK CARMEN AVALOS HAS MENTIONED.

I HAVE LIVED IN THIS COMMUNITY COULD I WAS BORN AND RAISED IN LA MIRADA.

I KNOW MANY OF THE STUDENTS WHO GO TO CERRITOS COLLEGE.

AND, CLERK CARMEN AVALOS KNOWS VERY WELL THAT THERE IS A DIFFERENCE BETWEEN A STUDENT WHO IS EXPERIENCING HOMELESSNESS AND SOMEONE WHO IS NOT A POTENTIAL STUDENT WHO WAS ALSO EXPERIENCING HOMELESSNESS THAT COULD POTENTIALLY WANDER INTO OUR COLLEGE CAMPUS THAT HAS NEVER HAD ANY INTENTION IN BECOMING A STUDENT, IS NOT A STUDENT NOR WILL BE A STUDENT AND MAY BE EXPERIENCING MENTAL HEALTH ISSUES THAT NEED TO BE ADDRESSED THAT WILL CAUSE A PUBLIC SAFETY ISSUE ON OUR CAMPUS AT ANY TIME OF DAY.

I THINK IT IS DISINGENUOUS OF CLERK CARMEN AVALOS TO MY WORDS AND TO CHIEF MUELLER'S WORDS TO MEAN THAT.

I WANT TO REITERATE THAT THIS IS SOMETHING THAT WE NEED TO TAKE A STRONG STANCE AND SHOW THE PEOPLE WHO PUT US INTO THIS OFFICE, OUR COMMUNITY THAT WE SUPPORT PUBLIC SAFETY AND IT IS AS SIMPLE AS THAT.

THANK YOU.

>> TRUSTEE: I DISAGREE WITH THAT.

I THINK YOU ARE MORE DISINGENUOUS IN PASSING JUDGMENT ON SOMEONE'S APPEARANCE AND WHAT YOU BELIEVE TO BE ON CAMPUS.

LEAVE THAT IS MORE DISINGENUOUS AND THAT'S THE PROBLEM.

IN SOCIETY WE LOOK AT WHATEVER FACTORS YOU PERCEIVE AS WAS HAPPENING.

YOU DON'T HAVE ANY IDEA WHAT THIS PERSON'S INTENTION IS.

YOU CAN'T ASSUME THAT.

THE FACT THAT SOMEONE WALKS ON CAMPUS WHETHER THEY ARE HOMELESS OR NOT HOMELESS IS PASSING JUDGMENT IF YOU CAN'T WALK ON CAMPUS AND LOOK A CERTAIN WAY.

I DISAGREE WITH YOU ON THAT.

AS TRUSTEES WE SHOULD CONTINUE TO OPEN DOORS AND NOT CLOSE THE DOORS BUT I WILL LEAVE IT AT THAT.

I'M GOING TO VOTE THIS DOWN.

>> PRESIDENT: DO HAVE A MOTION?

>> TRUSTEE: OF MOTION.

>> PRESIDENT: DO HAVE A SECOND?

>> TRUSTEE: I WILL SECOND.

>> PRESIDENT: PLEASE CALL FOR A VOTE.

>> TRUSTEE NINEL SUTHERLAND? CLERK CARMEN AVALOS? JAMES CODY BIRKEY? TRUSTEE ZURICH LEWIS? VP DR. SHIN LIU? TRUSTEE MARIANA PACHECO? TRUSTEE MARISA PEREZ? TRUSTEE DR. SANDRA SALAZAR? THE MOTION DOES NOT PASS PEER WE HAVE THREE YESES, FOUR NOSE AND ONE ABSTAIN.

>> PRESIDENT: THANK YOU TRUSTEES FOR DELIBERATING THAT DIFFICULT ISSUE.

NOW, ITEM 6.01 REPORT AND COMMENTS FROM DISTRICT OFFICIALS.

I WILL START WITH YOU TRUSTEE MARIANA PACHECO.

>> TRUSTEE: NO COMMENTS.

I CANNOT REMEMBER FROM ONE DAY TO THE NEXT BUT NO COMMENTS.

[LAUGHTER] SORRY.

>> PRESIDENT: CLERK CARMEN AVALOS?

>> TRUSTEE: NO COMMENTS.

[LAUGHTER] NOT BECAUSE I FORGOT I JUST DIDN'T BRING ANYTHING EXCEPT REMEMBER TO VOTE.

>> PRESIDENT: TRUSTEE ZURICH LEWIS?

>> TRUSTEE: A MIXED REALLY DISAPPOINTED TO SEE THE BOARD NOT ONLY ON A SECOND THOUGHT MOVE EVEN FURTHER IN FAVOR OF A VACCINE MANDATE BUT TO ALSO GO AGAINST THE MAJORITY THE VAST MAJORITY OF OUR COMMUNITY COLLEGE DISTRICT AND THE LEADERS THAT HAVE REPRESENTED IT AND THE PEOPLE WHO LIVE IN IT.

AGAINST THE WISHES THAT THEY WILL SOON MAKE KNOWN AT THE BALLOT BOX.

THANK YOU.

>> PRESIDENT: TRUSTEE MARISA PEREZ?

>> TRUSTEE: I HAVE GOOD NEWS TO REPORT.

FIRST OF ALL, I WANT TO SHARE SOME REALLY GOOD NEWS AND ACKNOWLEDGE EVERYBODY ON CAMPUS, OUR FACULTY, EVERYBODY, THE ADMINISTRATORS AND STAFF WHO HAVE WORKED ON THE ENROLLMENT.

LAST WEEK I PARTICIPATED ON THE HIGH SCHOOL SCHOOL SITE COMMITTEE AND WE WENT OVER THE CALIFORNIA DASHBOARDS STANDARDS WHICH BASICALLY ASSESSES DATA FROM EACH SCHOOL DISTRICT ACROSS THE STATE.

THEY WERE TALKING ABOUT EDUCATORS AND OUR PRINCIPAL SPECIFICALLY CALLED OUT CERRITOS COLLEGE WORK IN THIS AREA.

HE MENTIONED THE COLLEGE AND CAREER READINESS INDICATOR IMPROVED FROM 46.5 PERCENT TO 50.3 PERCENT.

AND, HE SAID HIS POSITIVE GROWTH TO THE DISTRICT PROGRAMS AND TO THE DUAL ENROLLMENT PROGRAMS AT CERRITOS COLLEGE.

I WANTED TO MAKE SURE TO THANK EVERYBODY FOR THEIR WORK ON THIS BECAUSE YOU ARE REALLY MAKING A DIFFERENCE AND EVEN THOUGH IT IS A SMALL INCREMENTAL CHANGE, HAVING OUR STUDENTS BE PREPARED WHEN THEY ENTER COLLEGE IS A HUGE ACCOMPLISHMENT SO I WANTED TO SHARE CONGRATULATIONS BECAUSE I THOUGHT IT WAS REALLY GOOD NEWS.

ALSO, THE LEAGUE IS GOING TO RECONVENE THERE TWICE A MONTH TRUSTEE WEBINARS THAT THEY DID AT THE BEGINNING OF COVID SO IT WILL BE THE SECOND AND THE FOURTH THURSDAY OF THE MONTH DURING LUNCHTIME SO YOU SHOULD HAVE ALREADY GOTTEN THE INVITE TO SIGN UP FOR ZOOM AND AGAIN CAN PARTICIPATE IN THAT.

THEY HAVE GOOD RESOURCES AND THEY DO A LOT OF THAT DURING LUNCHTIME AND I ENCOURAGE EVERYONE WHILE THEY ARE LISTENING TO THE TOPICS BECAUSE THEY ARE DONE IN A SHORT.

OF TIME.

THANK YOU.

>> DOCTOR SALAZAR?

>> TRUSTEE: I WANTED TO THANK DR. JOSE FIERRO AND ALL THE LEADERSHIP ON CAMPUS WORKING TO KEEP OUR CERRITOS COLLEGE CAMPUS SAFE FROM COVID AND KEEPING THEM HEALTHY.

I APPRECIATE ALL THE HARD WORK THAT EVERYONE IS DOING AND ALL THE COMPLIANCE ON

[02:40:02]

CAMPUS.

>> PRESIDENT: THANK YOU.

VP DR. SHIN LIU?

>> TRUSTEE: I APPRECIATE DR. JOSE FIERRO AND ALL THE LEADERSHIP TEAM FOR ALL THE HARD WORK.

THANK YOU.

>> PRESIDENT: THANK YOU.

I WILL GO AHEAD AND CONTINUE ON THE SAME THING.

WE HAVE DEFINITELY NOT MADE IT EASY ON YOU GUYS, VICE PRESIDENT AND PRESIDENT, THANK YOU SO MUCH FOR YOUR PATIENCE WE REALLY APPRECIATE NOT ONLY THE PATIENTS BUT HARD WORK COMING OUT ABOUT.

SO, THANK YOU FOR ALL THE WORK YOU'VE BEEN DOING OVER THE LAST MONTH AND SEVERAL MONTHS TO GET US UP AND RUNNING THIS SEMESTER.

IT IS PROBABLY ON PAR WITH LAST YEAR'S REOPENING AND MUCH APPRECIATED AND IT'S ONE OF THOSE THINGS THAT WE WANT TO MAKE SURE THAT IT GOES WIDELY KNOWN THAT YOU GUYS ARE FULFILLING THE GREATEST OF YOUR CAPABILITIES AMONG OUR STUDENTS SO THANK YOU SO MUCH.

DR. JOSE FIERRO?

>> SUPERINTENDENT: THANK YOU.

I HAVE A COUPLE OF ITEMS TO REPORT.

ONE IS A LITTLE LONG AND I GUESS I'LL START WITH THAT ONE AND THEN INITIATE THE GOOD NEWS.

SO, WE HAVE BEEN DEALING NO FOR A FEW MONTHS WITH AN ISSUE OF FINANCIAL AID REPORTS IN WHICH WE HAVE IDENTIFIED 6138 STUDENTS THAT HAVE ACCOUNTS, ESSENTIALLY.

WE HAVE BEEN DOING QUITE A BIT OF WORK IN ORDER TO FIGHT AGAINST THIS.

THE NUMBERS ARE STRANGE WE IDENTIFIED THIS WITH THE STUDENTS OF THE SUMMER OF 2021 AND THEN THE NUMBER JUMPED TO 5209 STUDENTS IN THE FALL OF 2021 AND WE HAVE ALREADY FOUND SEVEN FOR THE SPRING OF 2022.

WE HAVE DONE AN AUDIT OF ALL OF THE ACCOUNTS AND WE HAVE FOUND A FEW THINGS IN COMMON THAT WE ARE USING IN ORDER TO IDENTIFY ALL LOAN ACCOUNTS AND LAW DISBURSEMENTS OF MONEY.

THE FIRST CHARACTERISTIC TO ALL OF THESE INDIVIDUALS IS THAT THEY USUALLY USE ONLINE PHONE NUMBERS, THEY USE THE SAME ADDRESS AND ID GOOD THIS COULD BE ANYWHERE WHERE THEY ARE COMING FROM.

>> PRESIDENT: DO YOU REALLY WANT TO GIVE AWAY ALL OF OUR SECRETS?

[LAUGHTER] >> SUPERINTENDENT: THERE IS A LIST THERE THAT WE HAVE BEEN ABLE TO IDENTIFY.

THANK YOU FOR THAT! AND WE HAVE IDENTIFIED ALSO A SERIES OF STUDENTS THAT ARE ENROLLING IN COURSES.

MORE FREQUENTLY AND MORE VIGILANTLY.

WE HAVE DISPERSED UNDER $1 MILLION IN FINANCIAL AID.

WE ARE TRYING TO TRACK THOSE DOLLARS.

WE HAVE REVERSED 72 OF THE 77 DISBURSEMENTS AND WE HAVE BEEN RELATIVELY SUCCESSFUL RECEIVING SOME OF THAT MONEY.

WE ARE ADDRESSING THIS IN MULTIPLE WAYS ONE OF THOSE IS THAT WE ARE WORKING WITH THE OFFICE OF THE INSPECTOR GENERAL AND WORKING WITH THE CHANCELLOR'S OFFICE AND STAYING IN LINE WITHOUT FORGIVING ALL OF OUR SECRET, WE HAVE A SERIES OF STEPS THAT WE ARE TAKING IN ORDER TO BE ABLE TO MINIMIZE THE INCIDENTS.

THESE ARE NOT NECESSARILY NEW TO US.

EVERY SEMESTER WE TRACK THESE AND WE MAKE CORRECTIONS OF WHAT IS NEW WHICH IS WHAT WE SAW AT THE BEGINNING OF THE FALL SEMESTER WITH THE OVER 5000 STUDENTS REGISTERING.

THIS HAS A TERMINUS IMPACT BECAUSE NOT ONLY DO WE HAVE TO ESSENTIALLY IDENTIFY THESE INDIVIDUALS, REMOVE THEM, TRACK IF THERE WAS ANY DISBURSEMENT OR NOT OR IF ANYONE IS ON THE CLASS COUNT ENROLLMENT WHICH MAKES IT COMPLICATED FOR US TO APPROPRIATELY TRACK ENROLLMENT PATTERNS FOR ALL THE STUDENTS.

AS I SAID BEFORE WE ARE PULLING POLLS DAILY AND WE'RE LOOKING AT THE ACCOUNTS AND IF WE DON'T SEE ANY ACTIVITY THEN OBVIOUSLY WILL CLOSE THE ACCOUNT AND WE BLOCK ANY FURTHER ACTION FROM THAT.

WE WILL CONTINUE TO MONITOR THE SITUATION AND REGARDLESS OF WHAT I SAID BEFORE, THERE ARE STEPS THAT WE WILL CONTINUE TO FOLLOW AND ADD A FEW MORE TO TRY TO MINIMIZE THIS ISSUE.

FOR SOME REASON, WE ARE ONE OF FOUR COLLEGES IN THE LA AREA THAT HAVE BEEN THE TARGET HAS SUCH A HIGH LEVEL.

>> TRUSTEE: THANK YOU, I DO HAVE A FEW FRIENDS WHO WERE WORKING WITH THE COLLEGE AND I SENT YOU AN EMAIL TO BE ABLE TO IDENTIFY SOME ACCOUNT OF STUDENTS.

I AM HOPING THAT THE IMPACT TO THE COLLEGE, UNFORTUNATELY WE DO HAVE THIS HAPPENING BECAUSE WE ARE ONE OF THE TOP SCHOOLS.

WE HAVE 60,000 STUDENTS AND IT IS VERY DISHEARTENING BUT WE ARE ALSO TRYING TO FIX IT I HOPE IT WILL MINIMIZE AND HELP THE STUDENTS WHO ACTUALLY NEED IT.

>> SUPERINTENDENT: WE WILL CONTINUE TO DO THAT.

WE WILL KEEP YOU UP-TO-DATE AND WE WILL SEND YOU A REPORT OF ADDITIONAL STEPS.

WHAT I'M TRYING TO SAY IS THAT WE ARE DOING EVERYTHING WE CAN TO MINIMIZE THE IMPACT AND THE IMPACT IS NOT TO SIMPLY FINANCIAL AID LOSS BUT THE MAN-HOURS THAT ARE GOING BEHIND IDENTIFYING, REMOVING, CLEANING, REDOING ENROLLMENT AND THE DIFFICULTY OF TRACKING WHERE WE ARE OBVIOUSLY WHEN WE HAVE 5000 ACCOUNT.

>> PRESIDENT: THANK YOU.

>> SUPERINTENDENT: THE NEXT THING IS ATHLETICS.

AND IF YOU ARE APPROACHING THE COMMUNITY, YOU KNOW WHAT WE ARE DOING.

WE ARE ENGAGING IN A COMPETITION.

WE HAVE A SERIES OF PROTOCOLS WITH ATHLETES AND COACHES.

LARGELY THEY HAVE BEEN INCREDIBLY HELPFUL DURING THIS WORK AND EVEN TO THE POINT WHERE WE HAVE TESTED SOME OF OUR SYSTEMS LIKE OUR HQ AND IN-HOUSE TESTING WITH ATHLETES BECAUSE THEY BEEN TESTING WEEKLY SINCE MARCH AND HAVE DONE A GREAT JOB WITH THAT.

SO, WE BROUGHT A COMPETITION TO PARTICIPATE WITH THE STATE WITH OUR RETURN TO CAMPUS PLAN THE SAYS NO PUBLIC EVENT.

SO, WE OPEN ATHLETICS AND AS OF RIGHT NOW THEY HAVE PLAYED WITHOUT AN AUDIENCE.

AND AS OF TODAY WE ARE RECEIVING A NUMBER OF CONCERNS THAT THEY WOULD LIKE TO SEE ATHLETES PLAYING.

WE UNDERSTAND.

WE WOULD ALL LIKE TO SEE THE ATHLETES PLAYING.

WE ARE WORKING IN A PROCEDURE TO BE ABLE TO ALLOW SPECTATORS ALL THE STADIUM AND AT THE FACILITY FOR THE PROCEDURE IS NOT READY FOR THIS FIRST WEEK OF EVENTS BECAUSE THE PRIORITY HAS BEEN THE STUDENTS ON CAMPUS INCLUDING THE ATHLETES SO THEY CAN PARTICIPATE IN SPORTS OR THE STUDENTS CAN ATTEND CLASSES AND TO MAINTAIN OPERATIONS WITH MINIMAL INSTRUCTIONS.

I UNDERSTAND THAT SOME ARE DISAPPOINTED BECAUSE THEY CANNOT COME TO THE OPENING GAME ON SATURDAY BUT BY NEXT WEEK IF EVERYTHING GOES WELL WE SHOULD HAVE A PROCEDURE THAT WILL ALLOW US TO HAVE AN AUDIENCE AT OUR GAMES TO A LIMITED CAPACITY AND FOLLOWING A RETURN TO CAMPUS PROTOCOL.

WE WILL KEEP EVERYONE INFORMED WITH THAT BUT AT THIS PARTICULAR POINT WE DON'T HAVE A PROCESS THAT IS SUFFICIENT ENOUGH FOR US TO BE ABLE TO BRING THE PUBLIC INTO ATHLETIC EVENTS.

WE HAVE A PROCESS THAT ALLOWS TO HAVE OUR STUDENTS COMPETE IN THE SAFEST WAY POSSIBLE BUT THE PROCEDURE WILL ALLOW THE AUDIENCE WITH THE GAMES TO BE READY NEXT WEEK.

YOU MAY HEAR THAT IN THE COMMUNITY AND THE REASON IS WE ARE LOOKING AT ALL THE PROTOCOLS TO ENSURE ENEMAS ANY TYPE OF OUTBREAK THAT COULD LEAD TO A POTENTIAL CLOSURE OF A PROGRAM OR DISRUPTING THE EDUCATIONAL PROCESS OF THE CAMPUS.

AND LAST BUT NOT LEAST I WOULD LIKE TO ASK ALL OF YOU TO JOIN ME IN AN AND RECOGNIZING THE HARD WORK OF OUR FACILITIES TEAM.

WE RECEIVED AN EMAIL ON MONDAY OR TUESDAY, I CAN'T REMEMBER THIS WEEK IT IS ALL RUNNING TOGETHER.

WE HAVE TO CLOSE DOWN THE LIBRARY AND THAT BUILDING.

AS YOU KNOW THE BUILDING WHERE THE LIBRARY IS, IS NOT JUST A LIBRARY BUT THERE ARE CLASSROOMS AND IS A LARGE BUILDING.

THE BUILDING DID NOT HAVE THE RIGHT CIRCULATION SO WE MADE THE DECISION TO SEND EVERYBODY HOME AND THE REASON THEY COULD NOT OPERATE THE AIR CONDITIONING IS BECAUSE A TRANSFORMER THAT RUNS THE BUILDING IS NO LONGER FUNCTIONING.

IT IS ON A BACKLOG OF MANY WEEKS TO BE ABLE TO GET A NEW TRANSFORMER AND THERE IS A SHORTAGE OF MOBILE UNITS THAT WE COULD TEMPORARILY BRING TO CAMPUS AND PUT IN THE BUILDING.

SO WE WERE GOING TO HAVE TO SHUT DOWN THE BUILDING FOR SEVERAL WEEKS BUT THE FACILITIES TEAM GOT TOGETHER REVISITED THE SITUATION, THEY HAD A BRILLIANT IDEA TO CHECK TO SEE IF THE TRANSFORMER FROM THE OTHER BUILDING WILL SUPPORT THE WORK UNTIL WE GET A NEW TRANSFORMER.

THEY DID THE BACKGROUND WORK AND THEY QUITE LITERALLY WORKED THROUGH THE NIGHT OF MONDAY TO BE ABLE TO OPEN THE BUILDING FULLY FUNCTIONAL ON TUESDAY MORNING.

SO, THERE WAS A LARGE TEAM OF FACILITIES, SOME OF THEM WERE CONTRACT ERRORS WHO CAME UP WITH AN IDEA, TESTED EVERYTHING TO ENSURE IT WORKS, HOLD DOWN THE BUILDING FOR THE STUDENTS, FACULTY AND STAFF AND EVERYONE ELSE TO BE ABLE TO COME TO A FULLY FUNCTIONAL BUILDING.

I WOULD LIKE TO STATE MY GRATITUDE FOR THAT AND I WOULD LIKE TO OBVIOUSLY, ALL OF YOU EXPRESSED A GRATITUDE FOR THE WORK AND PULLING AND ALL-NIGHTER TO ENSURE THAT THE SERVICES WEREN'T INTERRUPTED.

IT IS A TOUGH ONE TO DO PARTICULARLY WITH THE TRANSFORMER AND WE DID NOT KNOW IT WOULD WORK.

I WANTED TO THANK YOU FOR THAT AND IT DEMONSTRATES THE COMMITMENT THAT ALL OF US HAVE TO KEEP THE COLLEGE OPERATIONS AS CLEAN AS POSSIBLE WITHOUT INTERRUPT INTERRUPTION.

THANK YOU.

>> PRESIDENT: THANK YOU FOR ALL THE PROGRESS.

WE DEFINITELY, IN MOMENTS LIKE THAT WE REALIZE HOW EXCEPTIONAL THE FOLKS WE HAVE ARE IN THE COMMUNITY.

THAT IS FANTASTIC TO HEAR ABOUT.

SO, WITH THAT WE WILL ADJOURN TO THE CLOSED SESSION AND MOVE INTO - ADJOURN THE OPEN SESSION AND GO TO CLOSING SESSION.

WE HAVE ANYTHING FOR THAT AND I HOPE EVERYONE HAS A WONDERFUL EVENING.

THANK YOU SO MUCH.
